Position

Partner in the litigation department, public law and regulation group and EU/competition team leader; main practice areas cover UK and EU competition law, including competition litigation before the UK and European courts, behavioural competition law and compliance, cartel investigations, dawn raids and leniency applications, abuse of dominance and merger control before the OFT and EU Commission, as well as state aid law; EU law and related sectoral regulation, including international trade, internal market and public procurement. Over 20 years' experience representing clients, both complainants and defendants, before the competition authorities; listed as a leader in the legal directories. Recent cases include appearing in appeals before Competition Appeal Tribunal against the OFT in a construction industry cover-pricing bid-rigging case and the construction employment agents cartel case; advising on follow-on damages claims in CAT and lead competition partner for Aventis in vitamins cartel damages cases before the CAT and High Court (the first cartel damages cases) and in Part 20 third-party competition damages claim; appearing for The HALO Trust in interlocutory public procurement proceedings against the Secretary of State for International Development in the High Court (TCC) and Sultan Properties against Rochdale MBC, as well as defending the Departments of Education and of Finance and Personnel of Northern Ireland in injunction proceedings against the award of framework agreements in Northern Ireland worth £650m and £850m respectively. In March 2012, European Commision ordered France to repay €650m of aid, the road transport former subsidiary of SHIF in a case where he represented the main complainant.

    The Presidium of the Supreme Commercial Court of the Russian Federation (hereinafter - SCC RF) adopted by the Informative Letter No. 156 dated the 26th of February, 2013 (hereinafter - the Informative Letter) on Review of the consideration by arbitrazh courts of the cases on the implementation of the public order clause as the ground for rejection of the recognition and enforcement of the foreign court decisions and arbitral awards.
  • China Customs New Interpretation

    For many products, tariff classification can be technically complex, confusing, and subject to multiple interpretations. Often several different Harmonized System Codes ("HS Code") may seem applicable for one given product with different tariff rates. Tariff classification is indeed a process of application of customs classification rules, including customs rulings and decisions, and misclassification may trigger severe legal consequences. The sad fact is, unfortunately, that many companies rely on non-legal professionals to determine the HS Codes for imports or exports. A recent interpretation issued by the General Administration of Customs of China ("GACC") (Circular No. [2012] 495 Shu-Fa-Fa) (the "Interpretation") reinforces the process of tariff classification as a legal matter, and formulates the test as to what counts for regulatory violation if tariff classification rules are improperly applied by the importer or exporter in a given case. If the legal defense is successful, misclassification may only be treated as a non-violation misclassification, with the possible obligation to pay up additional customs duties, if any, but without administrative or criminal consequences. The Interpretation took effect as from February 1, 2013.
