Position

Stephen is head of Brodies’ litigation department and has 17 years’ experience of dealing with a broad spectrum of contentious and business critical matters involving real estate, finance and energy (in particular oil & gas) clients. He specializes in solving contractual and asset-related disputes including real estate, infrastructure and finance issues. Stephen heads up the Business Disputes & Asset Recovery team which includes 8 partners and 50 people delivering solutions in IP, Real Estate, Banking and Finance, Insolvency, Energy, Commercial Litigation and debt recovery matters. Stephen and the team utilize the full range of dispute forum to achieve the clients' objectives including driving cases through the Sheriff Court, Court of Session, Lands Tribunal and Land Court. He has conducted arbitrations and mediations throughout Scotland. Commercial debt recovery, Lease enforcement (including complex dilapidations and repairing issues) together with property portfolio debt recovery are also part of his repertoire. He has led and advised on high value cases involving contractual interpretation and misrepresentation claims which have been determined by the Supreme Court in London.

He acts for oil & gas companies, private equity funds, commercial lenders‚ institutional investors, estate owners, retailers and corporate occupiers throughout the country.

Brodies LLP's team has vast experience in high-profile and business-critical litigation, with its workload spanning areas such as insurance, competition, IP/IT, shipping and pensions, among many other areas. Manus Quigg and Louise Shiels together have nearly 30 years of experience of construction disputes. Practice head Joyce Cullen has a 35-year track record in the commercial disputes arena, with a particular strength in banking and financial services litigation. Reflective of the high quality of the team, it includes a team of solicitor advocates across the offices in Edinburgh, Glasgow and Aberdeen (two of whom are standing junior counsel to the Scottish government).  Corporate restructuring and insolvency experts Rachel Grant and consultant Colin McIntosh are acting for the liquidators of RFC 2012 Plc (in liquidation); the matter recently involved a UK Supreme Court appeal on employee benefit trusts used for the benefit of football players and executives. In 2017, Alan Calvert, Odell Milne and associate Adam McKinlay successfully represented a firm of solicitors and its indemnity insurers at the UK Supreme Court in a case arising from the drafting of notices to quit in  agricultural tenancies. Laura McMillan made partner in November 2017. Kenneth MacDonald is a name to note in Aberdeen. Iain Rutherford, Stephen Goldie and Robert Buchan are also recommended. Tony Jones QC joined from BTO Solicitors LLP.

Brodies LLP delivers 'a very high level of service' on both volume and bespoke debt and asset recovery mandates. The team acts for a broad cross-section of clients, including banks, utility companies, debt purchasers and insolvency practitioners. It also assists English law firms requiring Scottish debt litigation support. Practice head Stephen Goldie, who has circa 20 years of experience, has a particular specialism in property-related debts, such as arrears of rent, service and common charges. Goldie and others are particularly active in handling high-value property repossession work for private investment firms that purchased distressed secured property portfolios from banks. Solicitor advocate Iain Rutherford  works with Goldie to manage the volume debt recovery offering, and also handles his own caseload of high-value and high-profile matters. Also active in complex, large-value cases is solicitor advocate Laura McMillan. Philip Hall (who focuses on corporate and plant hire debt recovery) and associate Monica Connolly are other notable figures. The practice was strengthened by the arrival in April 2018 of managing associate Marianne Griffin from Dentons . Santander Consumer Finance, Fleximize Limited and Moneybarn are among the firm's clients. Ricky Cannon departed for DWF, while Tony Jones QC joined from BTO Solicitors LLP.

Brodies LLP's 'incredibly professional' team has a tremendous record of success in dilapidations cases, complex disputes concerning contractual interpretations, and commercial landlord and tenant matters. Stephen Goldie and solicitor Chloe Postlethwaite are advising a private equity fund on various contentious issues associated with a retail park and large shopping centre, such as tenant insolvency, recovery of arrears, keep open actions and common parts issues. The firm has developed a first-rate reputation in disputes over business rates. Matthew Farrell and Postlethwaite recently acted for a number of non-domestic ratepayers (including accountants, oil companies and high street retailers) located in Aberdeen on challenging their business rates before the Valuation Appeal Committee. The purchase price for the acquisition of cashgate and the refinancing of cashgate's loan portfolio is partly backed by a bridge facility and is financed and refinanced by the sale of treasury shares (gross proceeds of CHF 112.8 million) in an accelerated bookbuilding, the placement of CHF 150 million perpetual additional Tier 1 bonds and CHF 250 million net share settled convertible bonds.
  • B√§r & Karrer Successfully Represents PNK Group Company in SCAI-Arbitration

    Bär & Karrer successfully represented a company acting under the trademark of PNK Group, a major developer of industrial facilities in Russia, against a Western European concrete plant engineering and manufacturing company in a SCAI-arbitration concerning the delivery of (defective) equipment. After full-fledged proceedings including a hearing with several technical experts, the client was awarded partial rescission of the contract (as requested) with returning of certain defective equipment against refund of its cost, a substantial price reduction with regard to the rest of the equipment, as well as a contractual penalty payment and reimbursement for 75% of all legal costs.
