Position

Carol is a recognised expert in all forms of secured finance but particularly asset-based lending and real estate. Carol regularly advises banks and developers/investors on development finance and investment loan facilities as well as acting for banks and independent finance houses in relation to receivables finance facilities. Recent successes include: acting jointly for Lloyds Bank and Santander on clubbed working capital facilities exceeding £50m to a key automotive supplier comprising CID, tooling, mortgage and hp lines; for Santander on clubbing a CID to facilitate third party investment in a client providing supplier finance; for  a manpower agency on its multi-million refinance with a syndicate of ABLs; for HSBC in numerous real estate secured transactions including the share acquisition of a BVI entity (owning a substantial commercial property in the UK) acquired by South African investor, Atlantic Leaf, from US investors.

Gateley Plc handles a range of transactions for borrowers and lenders, including MBO finance and non-bank lending advice. Andrew Madden  and Rebecca Sherwin (who also heads the firm's real estate finance practice) advised Clydesdale Yorkshire Bank as financiers of Evac+Chair’s MBO, and in the borrower space Madden advised Seafresh Group on a refinancing, which included securities over assets in both the UK and US and inter-creditor agreements involving the company’s Thai owners. Carol Betts advised HSBC on a £13m loan to a Manx company to purchase the Thomas Cook headquarters in Peterborough via a BVI structure.
