Real estate litigation.


Tim is a partner and specialist litigator in Gateley’s Real Estate team, acting for large corporate occupiers, institutional landlords and developers, and with a wealth of experience in the residential sector. 

He has detailed knowledge of property-related litigation, dealing with substantial dilapidations claims, exercising and challenging break notices, disputed lease renewals, claims relating to landlord’s consent, service charge litigation, rent reviews, the Telecommunications Code, and the various methods of repossession. 

Tim also specialises in complex development agreements and development site clearance, advising on restrictive covenants, planning issues, rights of light, wayleaves, party walls, options, overage, compulsory purchase, and questions of contractual interpretation.

With a particular interest in insolvency issues, Tim has recently assisted on the property aspects of a number of high-profile administrations including the developer of the "Big Easy" restaurant in Covent Garden, and the Paul Raymond Revuebar. He is currently acting on various insolvency regimes for RSM Restructuring, KPMG, Grant Thornton, Allsop, Duff & Phelps, and Mazars. 

Tim’s other clients include Taylor Wimpey, Persimmon Homes, Oxford United FC, Crest Nicholson, Berkeley Homes, Virgin Media Limited, Bellway Homes, Banner Homes,, Malmaison and Hotel du Vin, La Tasca and The Real China. Tim contributes articles to the established property press, and regularly delivers seminars to clients and agents. His reported cases include Allied Dunbar Assurance Plc v Homebase Ltd [2002],  Old Monk Pub Co Ltd v Puzzle Pub Co Ltd [2004], MW Trustees Ltd v Telular Corp [2011], and Mann v Shelfside Holdings Ltd [2015].

Successes include:
- Strategic advice to major UK corporate on multi-million rental liability arising from CVA of Focus DIY
- Represented Thames Water in defeating Mayor of London's challenge to planning permission for £200 million desalination plant, securing water for 400,000 Londoners in times of drought.
