Property litigation.

Position

Joint senior partner and head of property litigation. Mark has conducted cases in most courts up to and including the landmark case of Pepper v Hart relating to construction of statutes. Mark’s current cases include large dilapidations claims, particularly in the Technology and Construction Court. Mark has a specialist knowledge of Leasehold Valuation Tribunal and Upper Chamber (Lands Tribunal) work relating to Right to Manage, service charge disputes and discharge of onerous matters affecting land. A case of particular interest is the entitlement of one Right to Manage company to manage a development comprising different buildings but shared grounds. Mark has also acted for parties in proceedings before the Land Registry Adjudicator. Mark is a qualified mediator.

Career

Trained Rowleys and Blewitts, Birmingham; qualified 1985; partner in present firm since 1987. Partner undertaking a variety of civil litigation, and claimant personal injury work, member of Law Society Personal Injury Panel. Subsequent move toward commercial litigation, and later substantially contentious and non contentious construction law following the gaining of a Postgraduate Diploma. Most recently dedicated to property litigation and dispute resolution. Qualified mediator. Chairman Shakespeares 2009. Current directorships: Birmingham YMCA
