Position

Penri is a commercial lawyer specialising in utilities and public procurement law, projects and all aspects of general commercial law with an emphasis on long term, complex, high value services and supplies contracts. Penri has an extensive procurement practice and has advised on numerous open, restricted, competitive dialogue and bespoke hybrid award procedures (subject to Treaty principles). Penri provides strategic advice and assistance to a range of public sector clients in relation to both contentious and non contentious public procurement issues. Penri regularly provides workshops, training seminars and news bulletins to public sector clients on all aspects of EC procurement law.

The substantial, multi-disciplinary team at¬†Blake Morgan LLP¬†is highlighted for providing 'excellent service'.¬†Matthew Smith, who¬†is especially adept in all aspects of non-contentious and contentious employment matters and has chaired a number of disciplinary and appeal hearings for universities, heads the practice.¬†It acts for a range of higher education clients as well as having links with education bodies such as the Association of University Legal Practitioners and the Sixth Form Colleges' Association. The team is acting for Swansea University and the trustees of the university pension scheme in relation to a case that is examining the meaning of ‚Äėunfavourable treatment‚Äô under section 15 of the Equality Act 2010 ‚Äď an action¬† brought by a former employee. Emyr Lewis¬†advises on a wide range of commercial matters and Richard Wade¬†is advising Keble College, Oxford on a construction project that will extend the college‚Äôs campus. Other key partners include¬†Susie Dryden;¬†Rachel Gwilliam,¬†who advises on areas such as construction and engineering; and Penri Desscan,¬†who specialises in procurement and other commercial matters.

On the non-contentious front, Louise Howells¬†is 'very experienced at social housing work', particularly as it relates to regeneration and development projects; she recently acted for Vale of Aylesbury Housing Trust on the acquisition of affordable housing units at Chinnor in Oxfordshire. Simon McCann continues to advise Greater Manchester Police on the transformation of its IT services programme - work which has recently included advice on all aspects of the procurement, both of the strategic development partner and the various IT contractors for specific work packages. Other highlights include Penri Desscan's work for Cardiff University on the procurement of a network refresh.   • THE VAT E-COMMERCE PACKAGE

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
