Contentious trust and probate

Position

Lloyd is a Partner and heads the firm’s contentious trust and probate practice specialising in dispute resolution and litigation concerning trusts and estates for professional trustees, onshore and offshore trusts, lay trustees and beneficiaries and fiduciaries and their advisers, HNW individuals, and charities. His clients are national and international.

Areas of work: trust disputes (claims for and against trustees); removal of trustees; asset tracing/recovery; will disputes (claims challenging the validity of a will); rectification/construction of wills and trusts; removal of executors; financial provision claims against estates (Inheritance (Provision for Family & Dependants) Act 1975; Court of Protection disputes (statutory will disputes, attorney and deputy disputes); and charity legacy disputes. Recent transactions: acted for the principal defendant in Brooke v Purton [2014] EWHC 547 (Ch) – the first reported decision on construction and rectification of a will following the Supreme Court ruling in Marley v Rawling, securing the client’s interests in the trusts under the will. Acted for a Dubai VHNW individual alleged to have breached his fiduciary duties in respect of a non-UK estate, in which domestic and sharia law principles applied, secured a worldwide settlement of claims in the client’s favour. Acted for a Guernsey resident beneficiary concerning a breach of trust claim and removal of trustees in respect of property held in the UK, ensuring the trust property was secured and sold for the beneficiary.
