Position

Pham Ba Linh is the Managing Partner of Lexcomm Vietnam LLC and Head of Finance, Projects, Energy and Infrastructure practice with more than 19 years of legal practice, focusing primarily on energy and natural resources, major projects and infrastructure, project finance, leveraged and acquisition finance, debt and equity capital markets, derivatives and structured products.

He is increasingly active in the international arbitration of complex and high-profile construction and energy-related disputes under various institutional rules.

Career

Ba Linh is particularly well known in the Vietnam market for his project finance, energy and infrastructure/PPP expertise, and he regularly presents papers at industry conferences on upstream oil and gas, pipelines, power, project finance and securities offerings. 

Ba Linh has acted for project sponsors, financiers, governments, equity investors and major works contractors. He has extensive experience working in both civil and common law jurisdictions, having previously based in Hanoi, Ho Chi Minh City and Melbourne. 

Ba Linh has a number of years international experience, having worked earlier in his career with leading Australian-based international law firm Freehills (now known as Herbert Smith Freehills) in its Melbourne office (Banking and Projects Practice Group) with a particular focus on all aspects of large-scale, long-term energy and major infrastructure projects in Australia both from project development and project finance perspectives.

Ba Linh wins praise from clients for his technical legal excellence as well as his outstanding commercial expertise. He has been recognised in the Asia Pacific Legal 500 (2015) as being ‘smart and very responsive’ and ‘key names in the team’ whose experience on Projects and Energy 'includes infrastructure development and project financing'​.

IFLR1000 2014 notes that he is very experienced 'advising on a wide spectrum of energy and natural resources matters, more specifically in oil and gas, and major infrastructure projects'.

Ba Linh is admitted to practice in Vietnam as a qualified lawyer of the Hanoi Bar Association and a member of the Vietnam Bar Federation. He is a Fellow of the Singapore Institute of Arbitrators (SIArb).

Nguyen Viet Ha and Pham Ba Linh advise a foreign buyer on a proposed purchase of a listed pharmaceutical company, while Luong Van Trung, who jointly heads the practice with Ha, assisted an investment fund managed by Maj Invest with the sale of a 27% stake in furniture manufacturer AA Corporation. Other clients include Daiwa Securities, which Ha and Linh are advising on the planned purchase of shares in Saigon Securities.

Lexcomm Vietnam LLC’s team is β€˜helpful regarding various issues in the petroleum and energy sector, such as production sharing contracts, taxes, gas and renewables’. Pham Ba Linh, who is β€˜enthusiastic, client-focused and knowledgeable in Vietnamese legal issues’, advises international oil companies on block developments and farm-ins regarding oil and gas blocks, and also serves as local counsel for developers of gigawatt-plus coal fired power stations. Nguyen Viet Ha and Linh advise Vietnam Electricity as project sponsor of the 600MW Nghi Son 1 coal-fired power plant, which will be built by an EPC contractor. Work in the transport space includes Linh advising a contractor on the Ho Chi Minh City Metro Line 1 project. The firm also acts for water plant developers and road constructors.

    On 6/20/2012, the National Assembly voted to adopt the Law on Price (the "LOP") in response to the public demand for an effective legal framework to control price manipulation from dominant enterprises such as gasoline, electricity, etc. The law will take effect from 01/01/2013 and repeal Ordinance No. 40/2002/PL-UBTVQH10 dated 26/4/2002 of the National Assembly Standing Committee (the "Ordinance"), which is conceived as outdated and containing certain provisions contravening the WTO’s regulation. This article describes the main features of the law and provides some insight into its potential impacts on the Vietnamese economy.
