Marion has acted in many areas of litigation including matters involving information technology, communications, unfair competition, Internet, media, environment, banking, corporate and healthcare issues. Marion is a member of the French Committee for International Civil Law (Comité Français de Droit International Privé). She is also a certified IFOMENE mediator and a member of the European Mediators Association.

Education

Marion Barbier obtained a postgraduate degree (DEA) in international commercial law from the Sorbonne in 1984 and was admitted as a solicitor to the Paris Bar in the same year. She specialises in Commercial Litigation (including International and domestic arbitration) and gained most of her experience at Jeantet & Associés in Paris. She joined Bird & Bird's Paris office as a partner in January 2000.

The IT and communications department at Bird & Bird handles IT litigation, cloud computing, big data, telecoms and fintech issues for clients such as Sodexo, Equinix, Mylan and Essilor. Practice head Stéphane Leriche specialises in technology partnerships and transactions while Ariane Mole leads the data protection sub-team with Merav Griguer, who recently joined from Dunaud Clarenc Combles & Associés. The Lyon-based Géraldine Arbant assisted Mylan with the development of a mobile application for medical use, and dispute resolution partner Marion Barbier represented a client in negotiations for a new agreement with one of its customers following the breach of a licensing agreement through its booking platform. In other highlights, the team assisted a major optical lens manufacturer with the implementation of multijurisdictional whistleblowing measures, including advice on data protection and labour law regulations. Cathie-Rosalie Joly joined from Ulys.

  • The new French regulation applying to national insurance contributions for managers and shareholders

    French insurance contributions on executive and shareholder remuneration (pay + dividends) have been substantially increased by the National Insurance Funding for 2013 Act, No. 2012-1404, of 17th December 2012. Until 31st December 2012, all dividends were subject to national insurance contributions on unearned income but henceforth, under Article L136-3 of the National Insurance Code, amended by Act No. 2012-1404, certain dividends   are considered as pay received by executives and shareholders and are therefore subject to the national insurance contributions on pay. The Act also abolished the ceiling on health insurance contributions payable by the self-employed and all this means that businesses must rethink the way that they have been structured until now.
