Caroline is an Associate in BTO Solicitors LLP’s Construction and Engineering Team. Caroline’s specialist area of practice is non-contentious construction. She has been involved in the construction and engineering industry for over 15 years.

Working in both the private and public sectors Caroline specialises in reviewing, drafting and negotiating construction and engineering contracts for projects throughout Scotland acting for employers or construction professionals alike. She is experienced in giving advice in connection with standard form contracts (SBCC, JCT and NEC) and related bespoke contracts such as schedules of amendments, guarantees, construction professional’s appointment agreements, collateral warranties, framework agreements and development agreements. Caroline also acts for funders and parties acquiring an interest in property; reviewing and assessing construction contracts to ensure that adequate protections are in place to safeguard her clients’ interests.

Caroline has a particular interest in regeneration projects and has been involved in a number of significant high profile regeneration schemes in Scotland since joining BTO. She also has considerable experience in the Retail and Leisure, Social Housing, Student Housing, and the Renewables Sectors.

Caroline regularly provides training sessions/workshops to clients. She has enjoyed speaking at construction industry conferences (recent seminars “Contracts: latest updates you need to know about” RICS QS and Construction Conference 2016, Scotland) and contributes to construction industry publications (recent publication “Striking the right balance over BIM” Project Scotland Magazine July/August 2016).

BTO Solicitors LLP handles a mix of contentious construction matters, which includes cases involving complex insurance/liability/quantum issues, contractual disputes and conflicts over final accounts and extensions of time, challenges to certification and construction defects. Jilly Petrie has particular expertise in this area. In addition, practice head Sandra Cassels specialises in construction and engineering dispute resolution. Elsewhere, the group advises on the non-contentious aspects of projects at all stages from inception to completion. It acts for a broad base of clients, including contractors, sub-contractors, local authorities, developers and funders. In 2017, Cassels and associate Caroline Earnshaw acted for Tigh Grian Limited in the delivery of 48 sustainable, energy-efficient and affordable homes to Link and Paragon Housing Associations. A notable growth area for the firm has been in mandates from hotel and leisure sector developers, with the team negotiating building contracts, professional appointment agreements, development agreements and facility agreements. Consultant Ann O’Connell, and associates Julie Scott-Gilroy and Claire Mills, are also recommended.
