Position

Partner in employment team in London, advising on all aspects of employment law, with a particular specialism in providing employment support in commercial transactions, and in particular the application of the TUPE Regulations. Bob also advises business on day-to-day employment issues and has significant experience in advising US clients on UK employment law issues. Recent significant matters include advising a television company on the employment implications of a large scale outsourcing, whereby the company’s call centre was relocated to India, with the loss of approximately 140 jobs. Bob advised on the employment implications of the outsourcing, including the potential application of TUPE, the administration of the collective consultation process in relation to the potential redundancies, on aspects of the individual consultation process, and on general employment issues arising out of the closure of the UK call centre. Bob also resolved the small number of claims that arose from the process in a cost-effective manner. Bob has advised clients on the potential enforcement of restrictive covenants against departing employees and directors and their new employers, and on the recruitment of a team of employees from a competitor. Bob has given employment advice in connection with several commercial property transactions for The Glanmore Property Fund Limited and related companies, including detailed advice on the practical application of the TUPE Regulations. He has also advised a charitable organisation providing pre-school nursery services on a number of transactions involving the TUPE regulations. One of these transactions was particularly complex, involving the transfer of employees from a local authority, collective consultation on changes of terms and conditions, and significant pension-related issues. Bob has also provided employment advice to a City-based firm of patent and trade mark attorneys, and advised a well-known inter-dealer money broker in relation to a number of employment disputes.

    1 What are the main statutes and regulations relating to employment? The main statutes relating to employment are the Portuguese Employment Code (approved by Law 7/2009 of 12 February 2009) and the Regulation of the Employment Code (Law 35/2004 of 29 July 2004) which is still in force notwithstanding the fact that parts have been revoked with the entry into force of the new Employment Code.
