Work Department

Property damage and recovery; commercial fraud.

Position

I specialise in ‘white collar’ fraud recovery and property damage litigation, both claimant and defendant, with a particular focus on utility damage claims. In my fraud work I deal with the full range of instructions, from recovering a few thousands of pounds from a repairer who submitted multiple fraudulent invoices to an insurer, to pursuing millions paid by a rogue employee to friends and associates, together with those friends and associates. I am well practised at obtaining fast injunctive relief, and have a particular skill in asset tracing; reviewing bank statements and picking out payments that may look legitimate, but in fact are further dissipation of the proceeds of fraud. I regularly speak to insurers and businesses on the risks and remedies available in fraud cases. My other focus is resolving property damage claims, particularly those involving underground utility damage. I have a good understanding of the technical aspects of the utilities industry, as well as the very specific law applicable to such claims and I use that knowledge to work towards common sense, practical solutions to any dispute. I also advise insurers on policy coverage in relation to such claims.

BLM ‘works hard to grasp the complexities of the situation in each individual matter’. Julian Smart, who ‘works tirelessly on clients’ cases from the beginning, staying on top of things’, continues to act for Towergate Financial in a piece of M&A litigation. Other work includes cartel follow-on damages claims and heavyweight civil fraud matters, often concerning insurance – Caroline Kane is a significant contact for this; she ‘has brilliant knowledge of ever case: she is like a walking dictionary and gets to the core points in ways she makes everyone understand’. Jagdeep Hayre handles a variety of cases for Birmingham City Council. The firm also acts for Fujitsu and European Risk Insurance Company.
