Career

Suhas is a Senior Partner in the Firm and a founding member of the Firm's Bangalore office. After graduating with a B.A., LL.B (Hons) degree from the prestigious National Law School of India University, Bangalore (NLSIU), he was called to the Bar in the year 1998.

Suhas does substantial work as part of the firm's Technology Law Practice. He represents some of the largest hardware and software companies in the world with regard to their operations in India. In particular, he has been responsible for assisting clients in setting up very large software development, R&D, engineering design, back office and BPO operations in India.

Suhas has strong experience in joint ventures, technical collaborations, mergers and acquisitions and strategic investments in the information technology, manufacturing, automobile and biotech industries. His work has included structuring, due diligence, advice on regulatory and anti-trust approvals, contract preparation and negotiations.

Suhas also handles large real estate projects of clients in the Bangalore office. In addition to Bangalore (and the State of Karnataka), Suhas has handled large real estate projects all over the country including in the cities of Pune, Hyderabad, Chennai, Coimbatore, etc. He also oversees a substantial portion of the complex commercial and criminal litigation in the office.

Suhas is very active in the aviation sector and assists several aviation manufacturers on sales to Indian entities (both in the private and public sectors including defense related sales/procurement). He has comprehensively advised many nuclear suppliers on liability issues under recently passed Indian laws. Suhas has advised many clients on Indian laws relating to trading of imported and locally procured goods, franchise arrangements, channel partner and distribution agreements, etc.

Suhas has spoken at various conferences including of the American Bar Association at Houston, USA on 'Legal Aspects of Outsourcing to India'. He has previously co-authored the (India) 'Chapter of Doing Business Around the World' published by the World Bank and co-authored articles published by the India Committee of the American Bar Association. He regularly undertakes training and legal update sessions to 'in-house' legal departments.

He is listed in the 2009, 2010 & 2011 Editions of the Guide to the World's Leading Technology, Media and Telecommunication Lawyers, the 2012 Edition of The International Who's Who of Internet, e-Commerce & Data Protection Lawyers and the 2011 and 2012 Chambers Asia Pacific Corporate/M&A section. He is listed in the Indian Lawyer 250's "40 under 45" leading legal practitioners in the country surveyed by Law Business Research Ltd.

The aviation, aerospace and defence team at Kochhar & Co. is jointly headed up by Piyush Gupta and Suhas Srinivasiah and counts Bell Helicopters, Embraer S.A. and AMETEK Inc among its clients. The group is instructed by International Air Transport Association on several matters including challenging an increased aeronautical tariff at IGI Airport Airport, before the Economic Regulatory Authority Appellate Tribunal. The team is also acting for Singapore Airlines on the revision of its corporate and commercial agreements relating to landing rights, sales and marketing and frequent flier programmes with third-party vendors of services.

Kochhar & Co.'s employment and industrial relations team is jointly led by Rohit Kochhar, Suhas Srinivasiah and Vijay Ravi and frequently assists its corporate clients with a range of labour law matters. The group assisted Textron India in handling serious allegations of corruption against one of its senior employees, relating to a $5m transaction. In another work highlight, a team led by Srinivasiah acted for Permasteelisa (India) on a large scale amicable termination of employees. Indrani Lahiri is also recommended.

  • WHHPL v NHAI

    New Delhi, 31st August 2019: West Haryana Highways Projects Private Limited (a Special Purpose Vehicle of Era Infra Engineering) was awarded a Concession Agreement by NHAI on DBFOT Toll basis for widening of existing two lane highway and also constructions of two new bypasses. Although WHHPPL substantially completed the work and Toll was stared in 2014, NHAI was not declaring the completion. Also WHHPPL suffered huge losses due to Project overrun including threat from Banks/Financial Institution w.r.t Insolvency Proceedings (needless to reiterate one such proceedings under I&B Code filed by Bank of Baroda (erstwhile Dena bank) was recently rejected by Principal Bench, New Delhi). It was the case of WHHPPL that NHAI failed to adhere to the terms of CA in fulfilling its obligation of handing over of land. The Arbitral Tribunal passed an Award in favor of WHHPPL inter alia agreeing with the contentions of WHHPPL and also held that NHAI was in breach of the CA. The Tribunal passed an award (including interest) of Rs.750 Crores in favor of WHHPPL .

    The Arbitration and Conciliation Act, 1996 (Act) provides the framework for arbitration and conciliation in India. Drafted on the basis of the UNCITRAL Model Law, it is divided into four parts. Each part governs a different aspect of the arbitration and conciliation process: a Part 1 governs commercial arbitration; b Part 2 governs the enforcement of certain foreign awards; c Part 3 governs conciliation; and d Part 4 contains supplementary provisions (regarding the power of the court to make rulings, etc.). The Act 2 was recently amended in 2016 with an aim to make it more robust by plugging the lacunae that existed in the original legislation.
