Thawat Damsa-ard is a partner and the chief litigator in Tilleke & Gibbins’ dispute resolution group. Widely regarded as foreign investors’ attorney of choice for legal conflicts where the outcome directly impacts future operations in Thailand, Thawat litigates fast-moving, high-stakes matters involving product liability, customs, the Foreign Corrupt Practices Act, white-collar crime, transportation and logistics, and cross-border disputes.

Together with his team of experienced trial lawyers, Thawat prosecutes and defends complex civil and criminal claims and matters of first impression through all stages of litigation, from seeking preliminary injunctions to negotiating settlements to appeals to the Supreme Court of Thailand. Thawat has been recognized as a leading lawyer in each of the past 11 editions of The Legal 500 Asia Pacific, in the 2009-2018 editions of Chambers Asia-Pacific, and in other definitive legal publications.

His extensive experience in transnational litigation has made Thawat a sought-after advisor by multinational corporations as well as Thailand’s Legal Execution Department, which recruited the firm to represent the state authority in high-profile extraditions. Its litigation capabilities are wide-ranging, though particular areas of strength include product liability, employment, IP and aviation disputes. In the aviation sector, Thawat Damsa-ard led a team that represented Air Lease Corporation in administrative court proceedings concerning the repossession of two aircraft. The team is also sought out for its formidable anti-corruption and compliance expertise; contacts include consultant John Frangos, who is advising a multinational transport company on anti-corruption, anti-money laundering and compliance in Thailand. Tilleke & Gibbins has a varied transport practice that spans rail, road, shipping, logistics and aviation. The aviation department is led by consultant John Frangos, who acts in complex disputes in Thailand and Vietnam. In recent work, Frangos and Thawat Damsa-ard acted for a US-based aircraft leasing company in relation to an administrative court case involving the repossession of two aircraft from a Thai airline; this matter tested the ability of the Civil Aviation Authority of Thailand (CAAT) to deregister aircraft without a court order. Further, Frangos and Damsa-ard are advising an airline on a high-profile collision at an airport, which caused extensive damage to the client’s aircraft. In the non-contentious space, corporate and M&A partner Charunun Sathitsuksomboon advised a Singaporean client on the acquisition of a Thai logistics company, which required advice on transport licensing and shipping requirements. Also recommended is transport and logistics expert Chinachart Vatanasuchart, who is highly experienced in international trade and customs, insurance and employment law.
