Position

Head of group leading a busy department engaged in a wide variety of substantial commercial litigation matters; specialises in international and domestic commercial litigation and arbitration; group comprises seven partners and 14 assistants. Recent cases include: BOC v Centeon Bio-Services, Inc [1999] 1 All ER (Comm) 970; 63 Con LR 104 – leading case on the exclusion of the right to set off; Kuwait Oil Tanker Company v Al Bader & Others [2000] 2 All ER (Comm) 271; (2000) 97 (23) LSG 44 – leading case on conspiracy; DW (UK) Ltd & Dentmaster Holdings Limited v Leonhardt & Others – acting for claimant in fraud claim arising from purchase of listed company, matter successfully settled through mediation; Telecential Communications (Canada) Ltd v Pirunico Trustees Limited – substantial counterclaim under share put option agreement against subsidiary of Dutch cable operator, dispute successfully settled through mediation; AWG v McBriety and Another – acting for the second defendant in substantial claim for damages arising out of AWG’s acquisition of Morrison plc (2002 to date); Joseph Abela Family Foundation v Albert Abela Family Foundation – acting as co-counsel with Liechtenstein lawyers for the corporate respondents in a US$80m ICC arbitration (2001 to date); Global Cricket Corporation v International Cricket Council (ICC) – acting for the prospective respondent in a threatened claim under ICC arbitration rules for substantial damages arising from the rights to international cricket events (2002 to date).

Career

Career: Articled at Lincoln’s Inn firm Blyth Dutton; qualified 1989; spent a year at Blyth Dutton after qualification before moving to British West Indies, where admitted to the Bar for a two-year posting; on return in 1992, joined City firm SJ Berwin & Co; partner 1995 in the international commercial litigation department; partner Olswang 1998 in charge of the commercial dispute resolution group; member of firm’s management board.
