Position

Andrew Petry is a partner in the projects team. He has a broad range of experience in the energy and infrastructure sectors, with particular emphasis on banking, project finance and PPPs in the PPP, renewables, waste, power, transport, accommodation and LNG sectors. Andrew’s clients are financiers, project sponsors, borrowers, public sector entities and infrastructure funds. Andrew advises on shari’ah-compliant financings and has a growing reputation for acting on alternative funding structures for projects.

Simmons & Simmons' presence in emerging markets deals is due in part to its sector focus, which sees it act for asset managers, investment funds, financial institutions and companies in the TMT and life sciences industries. It has a long track record of complex and high-value project finance transactions, notably in the power, LNG, mining and pipeline sectors. For lenders International Finance Corporation, European Bank for Reconstruction and Development and Commercial International Bank (Egypt), the practice handled the project financing of a bulk liquids terminal at Sokhna Port in Egypt. Another highlight saw it act for the government of Kenya in the commercialisation of oil reserves in the Lokichar basin, which involved two projects with a combined value of $5bn. Leading light John Sayers 'is able to advise lenders on a number of different financing aspects and share insight into international best practices', says a client who comments that 'I have worked with a fair number of London-based lawyers and John stands out as one of the most talented amongst them'. Simmons & Simmons is an experienced adviser to the central government on transport, waste, energy and defence infrastructure mandates, but also has international PPP and PFI capabilities. Practice head Richard Dyton is currently acting for Momentum Infrastructure - a joint venture of three leading contractors - in its bid for enabling and civil work contracts on the HS2 network, while Adrian Nizzola and Patrick Wallace are leading to advice to the government of Kenya with regards to the commercialisation of the large oil discovery in the Lokichar basin. On the financing side, Adam Cooper assisted a group of lenders including the IFC with the financing of a bulk liquids terminal for the import and storage of gasoil, LPG and LNG. Andrew Petry , Juliet Reingold and managing associate Simon Kenolty are also key names. Other notable clients include the MoD, the EBRD and TfL.

Orion and Fusion Capital instructed the group to handle the sale of Lynx Resources - the owner of the Sasa zinc, lead and silver mine in Macedonia - to Central Asia Metals, and the client-recommended Yves Baratte teamed up with Iain Duncan , Adam Cooper and Andrew Petry to oversee a major equity and debt investment into a major bulk commodity mining project on behalf of two private equity funds. The arrival of Stuart Dutson from Eversheds Sutherland (International) LLP significantly bolstered the firm's international arbitration capacities namely for cases pertaining to Africa, China and the Middle East; he is currently acting for the government of Indonesia in a bilateral treaty arbitration brought by Indian Metals & Ferro Alloys in the context of an investment in a coal mine in Kalimantan.

Simmons & Simmons holds a strong track record in the power sector, especially for the financing and development of solar projects in the UK and abroad, and large-scale power projects in the Middle East and Africa. In recent highlights, practice head Patrick Wallace and Andrew Petry advised the lender consortium on the debt financing of the Markbygden wind farm in Sweden, and Iain Duncan continued to assist Mainstream with its renewable energy joint ventures with private equity investor Actis pertaining to its generation plants in Africa and Chile. Also notable are Steven McNab and Adrian Nizzola who handled substantial mandates in the renewables space. The team recently welcomed finance expert Jen Yee Chan and corporate partner David Parkes from King & Wood Mallesons, and real estate and professional indemnity specialist Emily Monastiriotis arrived from Womble Bond Dickinson (UK) LLP .

  • Failure to counter financial crime: Norwich Union Life

    In December 2007, the Financial Services Authority (FSA) imposed a fine of £1.26m on Norwich Union Life (part of the Aviva Group), one of the largest life insurance businesses in the UK with around seven million customers. The fine related to failures to take reasonable care to establish and maintain effective systems and controls for countering the risks of financial crime. The fine is the latest confirmation of the emphasis being placed on protecting clients and customers from the threat of financial crime.
