Career

Max is head of the firm’s Employment Department. The bulk of Max’s work involves contentious employment issues, and he appears regularly as an advocate in tribunals up and down the country.

Before qualifying as a solicitor, Max spent six years with a London-based construction industry association dealing with industrial relations issues. He then moved north and dealt with a variety of contentious issues before joining Short Richardson & Forth in 1999.

Areas of Expertise
Max’s practice covers the full range of employment disputes through the tribunals to the appellate courts. He has a particular interest in cases involving the interface between law and expert opinion evidence (often a feature of disability discrimination cases) and those cases involving differing jurisdictions.

The type of cases dealt with reflect the growing complexities of employment law: increasingly disputes require precise analysis of different forms of discrimination and all require acute interpretation of sometimes complex factual issues.

Group actions by multiple claimants in asserting collective rights are increasingly common, as are cases involving multiple respondents caused by putative TUPE transfers or statutory defences under the Equality Act.

Additional Positions and Memberships

Max is Secretary of the Newcastle region Employment Tribunal Users’ Group, a member of the Employment Lawyers and the Industrial Law Society.

Max’s skills are noted by both the Legal 500 and Chambers Guide to the Legal Profession, where he is described as, “One of the premier class” and “Clear thinking, sound in judgement and approachable”.

Max Winthrop heads the employment law practice at Short Richardson & Forth, which has a strong profile for contentious work and acts for claimants - most notably senior employees - as well as defendants such as SMEs and PLCs.
