Kate is a partner in the Real Estate Litigation team at Shoosmiths. She works for retailers and other corporate occupiers, institutional landlords and investors as well as commercial and residential developers, banks and insolvency practitioners. Her practice is a mixture of preventative medicine advice (formulating and implementing strategies to eliminate or minimise litigation risk), Court based dispute resolution and more routine property asset management work - dealing with issues such as forfeiture, lease renewals, rent review and debt recovery. Noteworthy recent projects include: • acting for a plc investor/developer on all elements of site assembly and clearance, including the release of rights to light and other easements in the context of a £4.3bn extension and redevelopment project. ; • pursuing a complex property fraud litigation claim against several high net worth individuals on behalf of a retail bank; • dealing with the restructure of a property portfolio on behalf of a FTSE listed retailer. Advising on all aspects of the transition of 600 properties from the old franchise business model to a new bespoke model; Kate has been involved in many high profile cases including:- • Salvage Wharf Ltd & Anor v G & S Brough Ltd [2009] EWCA Civ 21 (rights to light claim); • Birmingham Development Corporation v Tyler [2008] EWCA Civ 829 (development nuisance claim)

Shoosmiths LLP’s team is ‘prompt, efficient, courteous and knowledgable’. National practice head Nick Shepherd  advised Student Castle on recovering possession of fifteen properties in order to redevelop a building into student accommodation, and continues to advise Tingdene Parks on an adverse possession claim regarding a strip of land connecting its caravan park to the foreshore. Paul Knight, who handles work concerning dilapidations claims and break notice disputes, heads the Birmingham property litigation team. The firm handles work regarding the real estate assets of insolvent companies: Kate McCall represented BDO as administrators of Seacourt Developments, seeking possession orders against the former directors of a company unlawfully occupying properties in Mayfair. Other clients include Central Midland Estates and Central England Co-operative, which Shepherd and Knight advise on dilapidations claims and lease renewals. Bukola Obadun-Craigs, whose practice crosses over with social housing, is a key senior associate.
