Position

Chris is a partner and heads Shoosmiths’ structured asset finance team. He has a wide range of experience of structured and asset finance transactions. In particular, he specialises in aircraft and rolling stock transactions such as operating and finance leases (including cross-border leases) and the sale and purchase of such assets. He has acted on behalf of a large number of clients in the aviation and rail sectors, including banks, leasing companies, manufacturers (aircraft and rolling stock), airlines, tour operators, train operators (passenger and freight) and air traffic control organisations. Examples of his work include acting for Hitachi Rail, one of the lead members of the consortium to replace the current fleet of high-speed trains in connection with the Department for Transport’s Intercity Express Programme (the project has a reported value in excess of £7bn); acting for Porterbrook Leasing in connection with the leasing of rolling stock worth in excess of £1bn to the Southern franchisee; acting for Stagecoach South Western Trains and East Midlands Trains in connection with the leasing of all rolling stock required to operate their franchises; acting for Stagecoach South Western Trains in relation to its proposed acquisition of a fleet of additional new or refurbished vehicles (reported value of up to £180m); acting for Freightliner Group in connection with the procurement of a fleet of new locomotives (and the related sale/leaseback); acting for Swiss International Air Lines in relation to the leasing and subleasing of various aircraft; acting for a tour operator in connection with the leasing and subleasing of various aircraft; acting for National Air Traffic Services in connection with the procurement of air traffic control systems and the leasing of air traffic control equipment; acting for a tour operator in connection with the procurement of an online reservation system; and acting for a tour operator in connection with a major outsourcing programme.

The aviation practice at Shoosmiths LLP handles cross-border transactions for aircraft, engines and helicopters in Europe and the US, as well as advising banks and investors on deal financing. Partner Martin Fleetwood and associate Sarah Fairweather further specialise in the application of the Aircraft Protocol to the Cape Town Convention, in addition to other security interest protections available to lessors and financiers. Team lead Chris McClure assisted key client Swiss International Air Lines with the multi-million-pound leasing of Airbus A319 aircraft from Clariden Aircraft Leasing, and represented the same client again in the termination of a lease of an Airbus A330 from GECAS for operational reasons. Other team members to note in Southampton include partner Joanne McGuinness and associate Emily Stocker. Manchester Airport, Blue Islands, National Air Traffic Services and Thomas Cook can also be found in the client base.
