Position

Simon is a partner in Shoosmiths’ EU and competition law practice. He has extensive experience advising on competition law compliance, merger control, competition investigations and litigation. As well as working with businesses to develop and implement effective compliance programmes for their staff, Simon regularly provides advice on the competition law considerations arising from clients’ day-today commercial arrangements. Simon deals with the OFT, the Competition Commission and the European Commission on behalf of companies under investigation, merging companies and complainants. He has advised in relation to cases before the General Court of the European Union in Luxembourg, as well as on competition investigations in a number of other jurisdictions, in Europe and elsewhere, including in so-called ‘’dawn raids’’ by competition authorities. Simon’s experience extends across a broad range of industries including food and beverages, brewing, clothing, video games, retail, wholesale and retail banking, insurance, infrastructure and transport.

The team at Shoosmiths LLP attracts praise for its ability to 'cover all major areas of EU law', with Simon Barnes singled out for his 'excellent knowledge of UK authorities'. Barnes, who has wide-ranging experience in EU and competition law matters, is developing particular expertise in the automotive sector, where he is handling a number of strategic matters for several well-known automotive brands, including reviewing distribution agreements. Recent highlights include acting for Micronclean as one of two parties under investigation by the CMA in its investigation into the cleanroom laundry sector, which involved allegations that JV agreements between the client and the other party to the investigation constituted a restriction of competition by object. On the merger control front, Barnes assisted Datix with obtaining merger control clearances in Australia and New Zealand for its acquisition of Riskman.
