Career

Scott specialises in litigation, insolvency and credit recovery law. His practice includes banking, insurance and commercial litigation as well as fraud (civil) asset recovery and advising both private and public sector clients. He acts on a range of litigation assignments including contractual disputes, negligence, fair trading claims, insurance, property trust and shareholder disputes and judicial reviews, as well as insolvency and credit recovery assignments. He has appeared in the District and High Courts, Court of Appeal, Supreme Court and Privy Council and has also been involved in mediations, expert determinations and arbitrations.

The firm's dispute resolution practice operates from all three of the firm's offices and is led from Auckland by Laura O’Gorman, who 'picks up technical and industry-specific matters very quickly'. She acted for Sky Network Television in claims against sellers of pre-loaded Kodi boxes in a case that raises key questions about piracy. David Broadmore is recommended for banking and finance, insolvency and contractual disputes and is 'client-focused and a good communicator who is calm under pressure'. In Wellington, Scott Barker acted for Zespri International in a Serious Fraud Office investigation into invoicing practises in China and Taiwan. Clients note that Sebastian Bisley is 'a great strategist - extremely thorough, with a clear understanding of what is at the heart of each issue'. Senior associate Oliver Gascoigne 'has a consistently calm approach and an excellent ability to get to the heart of an issue'. Buddle Findlay has a ten-partner team across three offices which blends insolvency expertise and litigation experience to create one of the deepest practices in New Zealand. It counts Bank of New Zealand, ANZ Bank, ICBC, KordaMentha, PwC, McGrathNicol, Deloitte and Grant Thornton among its key clients. For administrator and liquidator KordaMentha, the practice handled the NZ$550m administration and subsequent liquidation of companies in the Solid Energy Group. David Perry and Scott Abel in Auckland led that deal, with support from experienced litigator Laura O’Gorman. Litigator David Broadmore and special counsel Myles O’Brien are also recommended. In Wellington, Scott Barker is a key practitioner and peers also speak highly of Sebastian Bisley, who acted for a group of creditors, including Callaghan Innovation, in an application to set aside a creditors' compromise obtained by Trends Publishing, which resulted in a favourable decision in the High Court. In Christchurch, newly promoted partner Kelly Paterson specialises in commercial litigation, with a focus on insolvency.
