Position

Stephen is a partner specialising in PFI/PPP/NPD/hub and Energy projects. Advising both public and private sector clients as well as funders, he has completed projects in a variety of sectors including healthcare, education, street lighting, waste, waste to energy, defence, wind, hydro and fire and rescue. He has significant experience in bid-stage projects and also in advises parties on operational projects in the healthcare, education and street lighting sectors (including secondary market sales, major variations and disputes). Clients advised include Balfour Beatty Investments, Consort Healthcare, Nord/LB, North Lanarkshire Council, Sumitomo Mitsui Banking Corporation, Bank of New York Mellon, Co-operative Bank, Levenseat, Dexia Credit Local and RBS. Stephen’s extensive experience finds him sought out to advise both strategically and operationally on major projects, both at bid stage and during the operational phase. In Chambers and Partners 2015 sources say ‘he’s willing to give a view rather than just telling you what the regulations say – he’ll discuss the implications and find imaginative solutions.’

Shepherd and Wedderburn's group advises on all aspects of the initial procurement of projects, to design and construction, and then operation and maintenance. PPP, PFI, NPD and hub projects are among the cornerstones of the practice. In a particularly large-scale project in the social housing sector, Rhona Harper, Euan McLeod, and associates Lauren Thompson and associate Stephen Maughan, are acting for Wheatley Housing Group in the procurement and construction aspects of the £250m Transformational Regeneration Area project at Sighthill in Glasgow. Harper is also the lead adviser to States of Jersey on the procurement of its circa £250m Future Hospital Project. In 2017, team head Stephen Colliston (who has acted for funders in a number of projects recently) worked with director Nigel Sievwright and others to advise Nord/LB on DBFM schools projects at Carntyne & Blairdardie and West Calder, and also a DBFM health centres project at Gorbals and Woodside. Another notable area of activity for the firm, among others, is in renewable energy sector projects; Harper, Patricia Hawthorn and Colliston are part of the team which is advising the Acciona Industrial-led consortium on its bid for a 25-year contract to design, build and operate an energy-from-waste plant in Aberdeen. Senior associate Euan Murray and associate Sarah Channin are recommended.

Shepherd and Wedderburn handles capital projects and finance work for major care home operators and healthcare investment funds. It also acts for public bodies, including Councils and NHS Trusts, in relation to major NPD, hub and PPP transactions. Practice head John Elder is advising care home operator, Four Seasons Health Care Group, on Scottish aspects its restructuring and refinancing project, including a new facility agreement and the preparation of restructuring proposals for its third party landlords. Clare Foster and Stephen Colliston are advising NORD/LB on all aspects of the DBFM project for two health and care centres at Gorbals Health and Care Centre and Woodside Health and Care Centre; a mandate that includes assistance with project management, property, procurement, construction, facilities maintenance and finance. Daniel Lee is advising US-based MedSource on its acquisition of data trial services business, Datatrial, and post-transaction integration, which involved complex data protection issues.
