Position
EU, competition and regulatory law with a particular expertise in regulated industries such as energy, transport, media and communications. Regularly represents clients before the European Commission, Competition Commission, OFT, utility regulators and the national and European Courts. Elaine heads SJ Berwin’s energy and natural resources group. She advises on a wide range of energy-related matters, including gas and electricity liberalisation. She is also heavily involved in advising on the application of EU and UK competition law and regulation to the air transport sector. Elaine advises widely on global and European cartels and has extensive experience advising on other proactive and reactive behavioural matters. She also has an active merger practice, having developed a particular expertise in the application of the EC Merger Regulation and domestic merger provisions to complex private equity transactions, advising a range of private equity houses, funds and industry trade associations and investors in close conjunction with the firm’s private equity group.
Career
Trained Clifford Harris & Co; qualified 1987; Holman, Fenwick & Willan 1987-89; Freshfields, London and Brussels 1989-93; SJ Berwin 1993 to date; partner 1997. Holder of ‘Legal Business Competition Team of the Year’ 2000, for successfully challenging Ofgem on behalf of US electricity generators AES before the Competition Commission in their wholesale electricity pricing investigation.
