Position

Partner and head of department dealing with all areas of intellectual property and competition law, both contentious and non-contentious; particularly well known for work in the life sciences sector. Non-contentious experience includes advising on the acquisition of major IP portfolios and the exploitation and protection of IP; Clare has also advised in relation to many IP actions including: Lundbeck v Teva (escitalaprau) Marion Merrell Dow v Harris Pharmaceuticals (terfenadine); the Boehringer (parallel import) cases. An ‘impressive strategist’ who ‘sees all the angles’, Clare is ‘widely applauded for her incredible knowledge in the field and her understanding of what clients want’. She advised a number of household names on trade marks, copyright and design matters; acts for most of the parallel importers of pharmaceuticals in the UK (together with their trade association); and many leading generic pharmaceutical manufacturers located throughout Europe, India, Israel and the US.

    1 What are the main statutes and regulations relating to employment? The main statutes relating to employment are the Portuguese Employment Code (approved by Law 7/2009 of 12 February 2009) and the Regulation of the Employment Code (Law 35/2004 of 29 July 2004) which is still in force notwithstanding the fact that parts have been revoked with the entry into force of the new Employment Code.
