Position

Partner in intellectual property, technology litigation and arbitration. Clive has extensive experience of the litigation and arbitration of IP and technology disputes. He has acted for parties in industries including aerospace, electronics, telecommunications, IT, pharmaceutical, air conditioning, medical devices, retail, media and publishing. He has acted in many leading IP disputes. Reported cases include Alan Clark v Associated Newspapers; Totes Istoner v Fulton; Interlego v Tyco; Improver v Remington (Hong Kong); Sony v Saray Electronics; Apimed v Brightwake. He has acted for parties in numerous arbitrations under ICC, LCIA, CIArb and WIPO rules. He has sat as an arbitrator in an ICC arbitration and is on the WIPO arbitration panel. He has acted as mediator, having successfully completed the WIPO advanced mediation course. The bulk of his practice is concerned with patent, design and technology disputes. He has substantial experience of cross-jurisdictional litigation.

  • Cancelling insurance: insolvency and downgrade clauses

    One of the most common concerns for both parties to an insurance contract (including reinsurance) is that the other party might become insolvent and unable to perform its obligations under the contract. Both insurer and insured will therefore wish to have the right to cancel the insurance mid-term in the event of the other party’s insolvency, or a change in its financial circumstances that makes its insolvency a more likely prospect in the near future.
