Hepatitis E Concern for Cruise Liner Passengers

May 2008

Andrew Morton, a travel claims solicitor at Manchester law firm, Pannone LLP says the outbreak of Hepatitis E onboard the P&O liner Aurora is a concern for passengers who will now be agonising over whether they have contracted the virus.

Morton said, "A cruise liner is a confined environment and it must have been a major concern for passengers who upon learning of the outbreak onboard, realised there was nowhere for them to go to get away from the source of the virus."

Hepatitis E is a waterborne disease and contaminated water or food supplies have been implicated in major outbreaks. However person to person transmission is uncommon.

Some comfort for passengers affected is that if it can be proven that the outbreak was due to poor hygiene standards onboard, they should be able to claim compensation. Andrew Morton said, "The Aurora is operated by the P&O cruise line and passengers will be able to claim under the Package Tour Regulations. They also have redress via the Athens Convention on International Carriage by Sea. I would certainly advise anyone affected to seek legal advice."

Andrew Morton specialises in holiday hotel and cruise line sickness compensation claims and accidents on holiday. He is a member of the Law Society Personal Injury Panel, the Association of Personal Injury Lawyers and the Travel and Tourism Lawyers Association.
