St Philips Chambers (Chambers of Andrew Smith QC)

Elizabeth has a reputation for excellent client care, meticulous preparation and fearless advocacy. She combines this with an empathetic approach to parents involved in what are always stressful and emotive proceedings. Since completion of her pupillage, she has specialised solely in family law, and in the last ten years, has focused on complex public law care proceedings. Elizabeth has a specific interest in the representation of parents with learning difficulties, and cases involving serious non-accidental injury. Elizabeth has an extensive practice in care and adoption work. She acts for numerous Local Authorities, parents and guardians alike. In recent times, her focus has been on complex high court matters involving children who have suffered serious non-accidental injuries (including alleged ‘shaking’ injuries), and death. She is happy to act as senior junior in her own right, or to be led in appropriate cases. Elizabeth has a particular interest in the issues facing the proper assessment and treatment of parents with learning difficulties by Local Authorities. She has developed an extensive knowledge of the recommended parenting assessment models. In addition, she is experienced at ensuring that the clients are properly able to understand the issues and make their positions understood. Elizabeth has a good understanding of the rights and responsibilities of Local Authorities, and is known for her ability to effectively challenge all areas of Local Authority decision making, whether through detailed cross examination within the care proceedings, or by Judicial Review. Elizabeth has delivered numerous training sessions for solicitors, social workers and guardians. Elizabeth undertakes complex private law disputes in the county and high court. She is known for her direct and frank communication style, but with a sympathetic ear to the difficulties that can beset these difficult and stressful cases. She regularly acts on behalf of guardians appointed on behalf of children pursuant to FPR 16.3. She has a particular expertise in applications to leave the jurisdiction, largely acting for the parent who wishes to relocate. In addition, she acts in associated applications under the Hague Convention.
