Also noteworthy is the representation of a digital service provider in a liability and damages claim against a French telecoms operator pertaining to a security breach which allowed third parties to illegally connect to the defendant’s network. In noteworthy 2017 work, the team advised Griesson de Beukelaer on a longstanding three-dimensional trade mark infringement and parasitic action against Générale Biscuit Glico and Mondelez with regards to the Mikado chocolate biscuit stick, and a household hospitality name engaged the team to assist with IP matters related to the opening of a franchise restaurant within the premises of one of its hotels. In terms of copyrights work, Gougé defended an NGO against a copyright infringement claim brought by a former employee pertaining to the use of her photographs in the client’s magazine, and the group also assisted an artwork collector with copyright matters and merchandising rights related to loans for the organisation of an exhibition.
