Position
Michael deals exclusively with commercial issues facing the NHS. Prior to joining the firm, Michael spent 18 months on secondment to the NHS Private Finance Unit, where, he was involved in the review of PFI in the NHS announced by the incoming Labour government and the preparation of Guidance which was issued by the Department of Health in December 1999. Since joining the firm Michael has led teams advising NHS Trusts and foundation trusts in connection with 10 PFI schemes with an aggregate value of £2.6bn. He advised the Department of Health in drafting the NHS Transactions Manual which specifically addresses the issue of NHS franchising. He has recently advised (and is advising) a wide range of NHS organisations in connection with a statutory merger of two NHS trusts; an NHS Foundation Trust in relation to its bid to acquire an NHS trust; a PCT in connection with its divestment; and a PCT and a Council in connection with their community services divestment. In acting on NHS transactions referred to above and in his role in drafting the Transactions Manual, Michael has encountered and dealt with the following regulatory bodies: Monitor; The Transactions Board; The Cooperation and Competition Panel; The Department of Health; and HM Treasury. Michael has adapted thinking and documents from other sectors in advising NHS organisations on the following issues: a pathology outsourcing by an NHS foundation trust; a private patient unit management proposal by an NHS foundation trust; and a property development joint venture for two NHS foundation trusts.
