Macfarlanes LLP¬†‚Äėdemonstrates a reliable accessibility, and a willingness to turn around documents quickly‚Äô in ‚Äėcomplex corporate real estate‚Äô matters. The team has been involved in many of the market‚Äôs busiest asset classes including PRS, where Anthony Burnett-Scott¬†is acting for Legal & General in relation to PRS developments in Bath and Birmingham, and student accommodation, where Dan Marriott¬†advised Canadian investor Realstar Group on its acquisition of a block of student housing in Hammersmith. Property finance

Within: Property finance

The team at Macfarlanes LLP is 'excellent on all counts', and is known for its strength on the lender and borrower sides, advising on a wide range of asset classes, including student accommodation, PRS schemes, hotels and supermarkets. Alternative lenders make up a key part of the client base: department heads Colin Morgan and Clare Breeze  recently advised Venn Partners on a £46.7m facility to refinance a portfolio of PRS units, and Jat Bains acted for Legal & General's BTR fund on the financing of the development of Roseberry Place in Bath, as well as for Legal & General Homes on the financing for the infrastructure development at its Crowthorne site. The team also won work from significant new clients, including housing developer Bewley Homes, which it advised on a £55m land acquisition and development facility, and Supermarket Income REIT; Morgan and newly promoted senior counsel Laura Bretherton acted for the latter on a £100m revolving credit facility with HSBC, partially to fund its first three property acquisitions.

  • Finding the ‚Ä®right words

In the recent case of Newbury v Sun Microsystems [2013], the defendant argued that an offer to settle proceedings was ‚Äėin principle' only and that a binding contract could not be formed until further terms had been agreed and a formal contract had been signed. It supported this argument by referring to a statement, in the offer letter, that the settlement was to be ‚Äėrecorded in a suitably worded agreement'. ‚Ä©
