Position

Sebastian Lach handles compliance and investigation issues, as well as complex product safety and liability cases. In the field of compliance and investigations, Sebastian has advised various clients on the creation of global compliance systems. He has successfully advised on criminal matters (e.g. bribery, fraud, embezzlement) and internal investigations relating to more than 50 countries worldwide, including FCPA, SEC/DOJ implications. Throughout his career, he has handled more than 20 multi-jurisdictional investigations, most of them for Fortune 500 and DAX 30 clients.

Hogan Lovells International LLP ‘has an extensive network of experts at its disposal’. The compliance group, which includes specialists from the automotive, life sciences, technology, media and communications industry groups, is recognised for its ‘situational advice’. It has seen an increase in mandates from financial institutions. The group has experience in building and implementing global compliance systems, including the development of policies, processes and the implementation of whistleblowing structures, as well as business partner compliance. It is also praised for its ‘very good’ in-house training. Désirée Maier, who is ‘particularly good’, made partner and most recently conducted a compliance management system adequacy audit at a group of companies. Sebastian Lach leads the practice and is also noted.

Internal investigations

Hogan Lovells International LLP continues to be strategically focused on internal investigations in the context of compliance and white-collar crime, and the ‘professional’ team has ‘extensive expertise’ in technical terms and across various industries. It is instructed by companies in cases such as antitrust, money laundering and sanction infringement allegations, but also in cases of alleged embezzlement, tax evasion, harassment and bullying. Due to the mostly cross-border nature of the investigations, they often also have a Foreign Corrupt Practices Act (FCPA) and UK Bribary Act (UKBA) reference. Practice head Sebastian Lach is well versed in handling criminal cases. Désirée Maier made partner at the beginning of 2018 and focuses exclusively on compliance and internal investigations with a focus on the life sciences sector. The team was also strengthened at the associate level.

Hogan Lovells International LLP has a broad range of expertise in environment and planning matters, advising both on plant construction projects and on regulated public sectors such as energy, water, environment, infrastructure and utilities. The Düsseldorf team, which is led by Thomas Dünchheim, advises on special environmental law issues such as fracking, mining and excavation matters as well as immission control, nature conservation and waste law. In a recent hightlight it assisted an energy generation group with the approval of the construction of a gas and steam power plant. The group advised Akasol on environmental law issues relating to its IPO and, in a separate matter, assisted a major international group with the complex remediation of contaminated sites. The client base also includes long-term client Autobahn Tank & Rast, the German Red Cross Düsseldorf and IMS Messysteme. Product-related environmental law work is headed by Munich-based Patrick Ayad and Sebastian Lach, and is increasingly relevant for the automotive industry. Florian Unseld and Arne Thiermann joined the partnership in January 2018.
