Position

Partner in dispute resolution and litigation department in Glasgow.

John specialises in commercial dispute resolution. He acts in a wide range of contentious commercial contract, property and debt recovery matters. He is also particularly experienced in director disputes and cross border litigation.

John‘s extensive commercial property litigation experience extends to dilapidations disputes, breach of missives, recovery of arrears of rent, enforcement of keep open clauses and obtaining orders for the removal of unauthorised occupiers. 

He is regularly instructed in proceedings before the Commercial Courts of the Sheriff Courts and the Court of Session, where he has been involved in some of the more significant proceedings to call before the Court in recent years. He is also experienced in mediation and other forms of alternative dispute resolution.

As the Firm’ Head of Debt Recovery, John’s team assists clients with all aspects of the debt recovery process, from pre-litigation through to court proceedings and enforcement. He also acts in insolvency matters, regularly securing appointments and pursuing claims on behalf of insolvency practitioners.

John advises a very broad spectrum of clients, from private individuals, insolvency practitioners and SMEs to public sector organisations, major Scottish based companies and multi-nationals. The work ranges from high value, complex court actions raised in the Commercial Court of the Court of Session, to providing general contract and commercial advice.

The core team that focuses on commercial dispute resolution is led by Douglas Millar, who has more than 30 years of experience in this area. Another well-known name is Brent Haywood, who is acting for David King (the former chairman of Rangers International Football Club Plc) in a case brought by The Panel on Takeovers and Mergers over King's failure to make a mandatory offer to purchase all shares of the club (in accordance with the City Code on Takeovers and Mergers) when acquiring certain shares. Among his other highlights, John Bett acted for McGivney Construction in a matter concerning a former director's breach of fiduciary duties, and handled a circa £3m landlord and tenant dispute for Healthcare Environmental Services Limited. Paul Harper is recommended for his property litigation expertise.

Lindsays has a strong capability in personal and corporate insolvencies, with its team handling all aspects of administrations, liquidations and sequestrations. Partners Douglas Millar, Brent Haywood, Paul Harper and John Bett all have expertise in undertaking contentious insolvency matters at the Sheriff Court and Court of Session. Another notable individual is director Iain Penman, whose experience includes actions involving issues of gratuitious alienation and unfairly preferential transactions, and wrongful sequestrations, among others. The firm also provides assistance with non-contentious matters by providing day to day advice on directors' duties, debt and company restructurings, and trust deeds. It also leverages its dedicated residential property and estate agency departments to assist clients with the disposal of residential properties in insolvency cases.
