Position

Partner in Litigation department specialising in professional negligence, personal injury and medical negligence work. Iain is accredited by the Law Society in both professional negligence and personal injury law. Iain has a significant case load of medical negligence work as well as dealing with high value / catastrophic injury / fatal road traffic and work accident claims in both the Court of Session and Sheriff Court. He is regularly invited to Chair Conferences by training providers and deliver seminars to lawyers on aspects of personal injury practice and procedure as well as civil litigation costs and funding. Iain also has a particular interest in quality assurance and peer reviewing having acted as a Peer Reviewer for the Law Society of Scotland since 2003. He was invited to deliver a series of seminars to Chinese lawyers in Beijing in 2015 on the skills of peer reviewing and has a particular interest in the Chinese Legal Reform programme.

Career

Iain qualified as a solicitor in 1991 and became a partner in a medium sized practice in West Lothian in 1997. He set up his own practice, Compensation Lawyers (Scotland) Ltd in 2004, which he ran successfully until he joined Balfour & Manson in 2016 as a partner.

Appointed by Lord President Gill as a member of the Scottish Civil Justice Council Costs and Funding Committee (2017-2017); Peer Reviewer for Law Society of Scotland Quality Assurance Scheme assessing and marking the standards of legal advice being offered by legal aid practitioners in civil litigation (2003 to present); Member of Law Society of Scotland’s Pursuers’ Panel offering specialist advice to clients and members of the profession in relation to Solicitors’ Negligence (2003 to present); Member of the Law Society of Scotland’s Civil Justice Committee and associated working groups on aspects of the Civil Litigation (Expenses and Group Proceedings)(Scotland) Act 2018. (Jan 2017 to date); Accredited as a Fellow by the Association of Personal Injury Lawyers.

Balfour+Manson LLP’s ‘caring, friendly and professional’ team has significant experience in pursuing claims arising out of catastrophic road, aviation, fatal and offshore oil and gas related accidents, especially with complex causation and liability elements. The team is led by David Short, who has a strong track record in representing victims involved in sensitive major disaster claims, including multiple high profile serious air accidents. ‘Level-headed and highly organised’ David McIntosh acts for a number of claimants who have suffered catastrophic injuries in road traffic and work place accidents. Julie Clark-Spence focuses on in claims that arise out of offshore accidents and is currently representing a Polish National, who was injured whilst working on a vessel in Rotterdam, in the Court of Session, against three defenders, one of whom is domiciled in Singapore. Experienced litigators Ann Logan (who is qualified to practice in Scotland, England and Hong Kong) and Iain Nicol (who specialises in fatal claims) are also ecommended.

Balfour+Manson LLP is regarded as ‘a safe pair of hands’ and provides an ‘efficient service’ with respect to solicitor negligence cases in negotiations, mediation and litigation. The firm predominantly represents claimants in matters pertaining to the administration of trusts, executries and contentious disputes arising out of litigation, in addition to property-related matters. David Flint leads the team, which includes Gordon Deane and Elaine Motion , both of whom are noted for possessing extensive experience in the area of professional negligence. The group currently represented a US citizen in relation to a potential claim against their accountants for providing wrong advice regarding tax returns for a period of 13 years. Iain Nicol is another key contact.
