Position

Emmalene is a partner in the clinical negligence department and has over ten years of experience working in this area. Emmalene’s cases range from those involving maximum severity injuries to those where injuries are less severe but still have a significant impact on her clients. Emmalene specialism is in surgery cases including gynaecological, cardiac and general surgery, such as ectopic pregnancy, maternal injury after birth (third/fourth degree tears, bladder injury and fistulae) and delay in diagnosis of appendicitis. Emmalene has also developed a practice in infectious diseases and has obtained admissions and damages in claims arising out of the delay in diagnosis and treatment of Tuberculosis and Meningitis. Her recent work involves cases of Leishmaniasis, a disease spread by sand fly bites (found in Southern Europe, Africa, Asia, South and Central America), which if left untreated can result in significant pain and skin ulcers, or in cases of Visceral Leishmanias, fever, low red blood cells, and enlarged spleen and liver, which can prove fatal. Emmalene continues to act for families in respect of fatal injury claims, including stillbirths, neonate, children and adult deaths. She also acts for many of her clients at inquests.

Career

Trained at Evill and Coleman (now Russell Cooke LLP); Clinical Negligence and personal injury; qualified 2004; Leigh Day 2004 to date, practises exclusively in Clinical Negligence; partner in 2015. Emmalene is the author of the section on “Medical Negligence – Damages Overview” on Westlaw UK Insight, Westlaw’s online encyclopaedia of UK law: she is also the author of the firm’s response to the draft charter of bereaved people.
