This substantial Bournemouth broad-spectrum practice provides a range of services for businesses including commercial property, construction disputes, general company and commercial advice, employment law and computer and information technology expertise. Laceys is also very well known for private client work and in particular inheritance tax planning, wills and trust arrangements.

Laceys has one of the largest mediation practices in the area with full-time mediators having particular expertise and reputation in matrimonial dispute mediations. It has had for many years an experienced family team providing separation and pre-nuptial agreements, divorces, dealing with children matters both public and private, and collaborative law for financial and property settlements.

The firm: Laceys was founded in about 1860 and has expanded alongside the huge growth in the Bournemouth, Poole and Christchurch conurbation. Originally a traditional private client firm, Laceys has retained its traditional private client practice but has developed a thriving business practice. Commercial property has been a particular area of expertise for many years, including acquisition, disposal and financing of freehold and leasehold land for commercial, industrial or agricultural use. All types of business leases and planning matters are dealt with.

Employment expertise includes drafting contracts, unfair dismissal discrimination and redundancy.

Laceys can handle all forms of commercial and employment disputes, and the firm is particularly strong in both residential and commercial landlord and tenant law and disputes. Its strength in this field was recognised by its appointment this year as national solicitors for the Association of Residential Managing Agents.

Laceys’ well-known private client department handles inheritance tax planning, wills, winding up estates, court of protection work and powers of attorney.

All types of residential property work are dealt with and the firm has particular expertise in leasehold enfranchisement.

  • COUNCIL TAX

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

  • Judicial Review

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.
