Frédérique Pons, Co-founder and managing partner

Frederique Pons who founded Pons & Carrere with Nathalie Carrere explains what is so special with their tightly knit team.

What do you see as the main points that differentiate Pons & Carrere from your competitors?
  • Three women, three partners with complementary expertise;
  • an extensive practice in mass disputes;
  • a personal implication of the led-partner with a small-close team on each file;
  • a strong vigilance to comply with ethics as the co-founders are former members of the General Council of the Paris Bar.
Which practices do you see growing in the next 12 months? What are the drivers behind that?
  • Product liability with the increase of “class actions” à la Française;
  • Assistance to companies in order to help them complying with new “Ordonnances Macron”.
What's the main change you've made in the firm that will benefit clients?
  • Development with Caroline Henry of “Pons & Carrere Santé” a skill hub dedicated to the healthcare industry;
  • Caroline Henry joined the executive board of the Healthcare Data Institute, a think tank which studies the impact of Big Data in the health sector.
Can you give us a practical example of how you have helped a client to add value to their business?

Sometimes it is better for business to stop a case but clients are prevented to do so because of personal or emotional issues. It is quite common in family business. Our independence allows us to help clients to find a settlement without losing their face.

The firm’s expertise in both litigation and counselling gives us a special ability to foresee difficulties which may arise and thus, a specific capacity to help clients build a safer legal environment for their business and activities.

  • The new French regulation applying to national insurance contributions for managers and shareholders

    French insurance contributions on executive and shareholder remuneration (pay + dividends) have been substantially increased by the National Insurance Funding for 2013 Act, No. 2012-1404, of 17th December 2012. Until 31st December 2012, all dividends were subject to national insurance contributions on unearned income but henceforth, under Article L136-3 of the National Insurance Code, amended by Act No. 2012-1404, certain dividends   are considered as pay received by executives and shareholders and are therefore subject to the national insurance contributions on pay. The Act also abolished the ceiling on health insurance contributions payable by the self-employed and all this means that businesses must rethink the way that they have been structured until now.
