Dr. Markus Eichhorst studied law at the universities of Kiel/Germany and Essex/UK. Following his doctorate and qualifying as a German lawyer (“Rechtsanwalt”), Markus joined the Hamburg office of Ince & Co in 2001 and became a partner in 2008. From 2010 Markus worked as a Magistrate and latterly as a District Court judge. Preferring the challenges of private practice but armed with his judicial experience he re-joined Ince & Co in August 2012.

 Markus has significant experience of negotiating, litigating and arbitrating insurance, commercial and shipping disputes. Markus is a member of the German arbitration associations GMAA and DIS and is an officer of the Insurance Group of the International Bar Association (IBA).

 He has been involved in numerous marine and non-marine defence and coverage disputes under P&I, D&O and other liability policies as well as H&M, LoH, Builder’s risk and yacht insurance policies. Markus has advised on captive set-ups for international corporates; on business interruption policies and on environmental M&A risks.

 Markus has acted for insurers and reinsurers in coverage litigation as well as defending assureds in liability proceedings.

 Recent cases involve the coverage advice for D&O excess insurers in relation to allegations made by a board member of a German bank that allegedly caused significant losses, the civil defence of previous managers of a shipping company against shareholders and an insolvency administrator for alleged misconduct and related D&O coverage advice, assisting insurer clients in negotiating the wording of a Warranty & Indemnity policy, the drafting of Professional Indemnity policy conditions as well as coverage advice under a reinsurance contract in relation to floodings after storm Sandy.

The opening of Ince’s Cologne office in 2016, its second German office alongside Hamburg, is now bearing fruit. The ‘very well-versed and solution-oriented’ team, which is co-led by Stefan Segger, Eva-Maria Goergen and Markus Eichhorst, focuses on assisting liability insurers and reinsurers with coverage matters and on liability defence work. It also has expertise in product liability matters in the pharmaceutical, life sciences and food industries as well as energy sector-related property and technical insurance issues. The practice also acts as D&O monitoring counsel.

Ince is the result of Ince & Co and Gordon Dadds’ merger in December 2018. The ‘broadly based’ maritime and shipping law team is considered to be ‘readily available’ and has ‘an appropriate view of the economic aspects of a case’. Under the leadership of Markus Eichhorst, who specialises in contentious work, and Jan Hungar, who has a good reputation in financing and transaction matters, the team comprehensively assists national and international shipowners, ship operators, banks and insurers under German and English law. In addition to advising on major damage cases, shipbuilding and charter contracts, the practice also focuses on court and arbitration proceedings. In addition, it is also increasingly involved in the offshore energy sector. Christian Reinert, Julia Wiechell and Götz Rahne joined the partnership. Eckehard Volz, Tim Schommer and Volker Lücke joined Clyde & Co LLP at the end of 2018.
