Position
Partner with broad practice in insurance, reinsurance and commercial disputes. Throughout her career Carol has specialised in contentious work both in court and arbitration dealing with a wide range of disputes in shipping, international trade, general commercial litigation, insurance and reinsurance. She has experience in advising on disputes arising out of political risk, financial institutions liability and reinsurance policies in both court and arbitration. She has handled numerous claims emanating from emerging markets under a variety of political risk policies including expropriation, contract frustration, terrorism, political violence and trade credit. She has been involved in considering claims under Bilateral Investment Treaties, including their impact on investment claims under political risk insurance and as a means of recovery under subrogated rights. She has also been involved in reviewing political risk and trade credit policy wordings for insureds, brokers and insurers. Carol was recently seconded for four months to a leading Lloyd’s syndicate to handle its political risk and assist underwriters (2010). She contributed to a research paper on Expropriation commissioned by APIN and is a frequent speaker at conferences dedicated to the political risk insurance sector. Carol has experience in advising on complex reinsurance claims on issues such as aggregation. Her recent cases include Standard Life Assurance Ltd v Oak Dedicated Ltd & ors, acting for Standard Life, which involves the aggregation of third-party claims and brokers negligence.
