Position

Head of clinical negligence team at Hutton’s. Referral solicitor on the AVMA Panel since 1988. Hutton’s has been placed in Band A of Leading Firms for Clinical Negligence in Wales once again, with Tim Musgrave considered to be a ‘Leading Individual’. Chambers Guide comments: ‘Tim Musgrave is the leading figure in the practice. He impresses interviewees as ‘a gentleman, sympathetic with clients and someone that you’d regard as having a safe pair of hands’. Tim is also highly recommended in ‘Legal 500’, another respected Guide to the Legal Profession. It states: ‘Clinical negligence and human rights cases are a specialism of Hutton’s, one of the first Welsh firms to be awarded a Legal Aid franchise. Covering a full spectrum of claims, from RTA work to brain injury cases, the firm boasts the outstanding Tim Musgrave, who is a member of the Law Society Clinical Negligence Panel ...’. Areas of Expertise: ‘incredibly thorough and experienced’ and ‘head and shoulders above the rest’ are some of the descriptions applied to Tim Musgrave (see Chambers Guide to the UK Legal Profession). The small, focused team is ‘rightly placed at the top’ for the high quality of advice and wide coverage. ‘Hutton’s has a high-quality practice, with Tim Musgrave enjoying a strong reputation among peers and clients alike.’ Tim has dealt with all types of clinical negligence cases and recovered many millions of pounds on behalf of claimants. Has also often represented families with complaints against the NHS and at Inquests. Often asked to lecture to other professionals on this subject. Experienced in representing children and patients and liasing with the Court of Protection and the Public Guardianship Office. Deals with a whole range of clinical negligence cases with particular interest in catastrophic injury, birth injury and fatal accident claims. Recent cases: recently recovered £3.85m damages in claim against GP for child who suffered cerebral palsy following failure to properly advise parents regarding treatment. Other recent settlements include damages of £2.2m for adult with cerebral palsy who suffered further brain injury following a routine operation and damages of £2.5m for child who suffered catastrophic brain injury following cardiac arrest during surgery. Last year Hutton’s achieved a major victory in the cerebral palsy case A v Powys Local Health Board providing the client with the highest court award ever made following a contested trial: the first clinical negligence case to exceed £10m.
