Intellectual property

Position

James helps clients with intellectual property law and media issues. With a particular focus on contentious matters, he has extensive experience of disputes involving trade marks, passing off, copyright (whether artistic, literary or software), database rights, design rights, patents and domain names. 

His practice also regularly features work involving defamation, privacy and data protection issues (including interim injunction applications and the ‘right to be forgotten’). 

James has acted for major corporations, SMEs and private individuals in various forums including the High Court, the Intellectual Property Enterprise Court, the UK Intellectual Property Office and WIPO.

Having trained as a lawyer after a career in publishing, James joined the IP/IT team at Howes Percival as a partner in October 2015. He is primarily based in the firm’s Milton Keynes office, but looks after clients in locations across the UK.

Howes Percival LLP's south east practice focuses primarily on contentious work, with disputes specialist James Howarth heading up the regional team. The team is particularly experienced in the publishing and technology sectors, with an emphasis on technology manufacturers. Other key areas for the firm include software copyright and online issues as well as licensing.

With particular experience in reputation and privacy management, as well as IP, Howes Percival LLP's media team acts for both private clients and media-sector companies. The team primarily acts on contentious matters, including High Court and injunctive relief proceedings, with a particular focus on trade marks, copyright and passing-off on the IP side. James Howarth is the key figure within the firm's Milton Keynes office, and has substantial experience handling work for publishing sector clients. In non-contentious IP work, associate Jenna Bruce is a name to note given her in-house experience in the media industry.
