Intellectual property (IP)

Position

Partner. Jakob Krag Nielsen co-heads Lundgrenss IP team and advises on all IP matters. He works on establishing, commercialising and enforcing IP rights: (i) Establishment and maintenance of portfolios of IP rights, in particular trademarks and designs. (ii) Negotiation and preparation of all types of IP contracts, such as assignment agreements, techtrans agreements, research and development agreements and license agreements. (iii) Handling of all types of conflicts pertaining to IP or rules on marketing practices, including injunctions, search orders, invalidity proceedings and enforcement programs (parallel import and anti-counterfeit). The IP team co-operates with leading Danish and foreign patent agents on drafting and enforcing patents.

Career

Jakob joined Lundgrens as partner in 2013. Before that he worked with Plesner (2008-2012) and Kromann Reumert (1999-2008).

Languages

English and Scandinavian languages.

Member

Positions of trust includes the CCBE's subgroup on patents, the Danish Bar and Law Society's IP expert committee and the Association of Danish Law Firms' IP committee.

Education

Jakob obtained his Master of Laws from Aarhus University (1999) and he holds an LL.M. from the University of Exeter HD(O), CBS.

Lundgrens provides 'very pragmatic disputes advice' in the commercial, construction, insolvency and real estate sectors. Peter Clemmen Christensen jointly leads the practice, is 'very strategic in his advice', and  recently acted for Steen & Strømin in a rental agreement dispute with Deichmann Schuhe. Other work includes fellow team head Dan Terkildsen acting for BankNordik in a liability claim brought by investors relating to a swap agreement, and Michael Amstrup defending a former director of the now-bankrupt Amagerbanken in professional liability claims. IP litigators Jakob Krag Nielsen and Rasmus Vang, arbitrator Niels Wive Kjærgaard, and insurance specialist Jesper Hjetting are also noted.

Lundgrens has a broad IP practice that is 'diligent', 'courageous' and 'open', and 'works as a real team'. Group co-head Jakob Krag Nielsen is an expert in contentious matters and recently handled multiple patent infringement cases a global pharmaceutical company; while fellow co-head Nina Ringen focuses on soft IP issues and assisted Perkins+Will with the IP aspects of its acquisition of Schmidt Hammer Lassen. Other noteworthy names include director Søren Danelund Reipurth, who represented Ilse Jacobsen in several copyright infringement claims relating to its wellington boots; and director Rasmus Vang, who specialises in IP litigation.
