The firm: Kambourov & Partners (KP) is a leading Bulgarian law firm with 30 years of unique experience and insight. It started out as a litigation-focused practice but over the years evolved into a full-service law firm thus offering its clients any type of legal support they may require in the course of their business.

History: Privatization of state-owned companies in the late 90s acted as a major push in the firm’s development. Kambourov & Partners have been retained to represent either the Bulgarian state or prospective buyers of key state enterprises in virtually all sectors of the Bulgarian economy, most eloquent examples being the privatizations of the Bulgarian Telecommunications Company, Bulgartabac Holding, National Movie Center, electricity distribution companies, National Cargo Railway Operator, Municipal Bank, etc.

In addition to that, since the early 90s the firm has actively participated in the development of the banking sector in Bulgaria. The firm’s unique experience commenced with the first ever and still biggest bank insolvency – of First Private Bank in 1996, where name partner Yavor Kambourov acted as assignee.  Among the firm’s recent mandates are assisting clients such as HSBC Bank Plc, Barclay’s Bank, ING Bank, ADM Capital, IFC, as well as all major local banks.

The energy sector also acquired a significant place in the firm’s practice, positioning it as a first tier law firm for the past decade. Litigation, Arbitration and ADR: Launched in 1988 as a dispute resolution law firm, KP remains unrivalled in its experience before Bulgarian courts and in domestic and international arbitration proceedings. We cover all types of individual claims in all areas of business law, including banking and finance, corporate and commercial litigation, unfair competition, energy and project finance disputes, insurance disputes, IP litigation, procedures for recognition and enforcement of foreign judgments and arbitral awards. The firm is among the few in Bulgaria that have experience in collective claims. The team has an impressive background in multijurisdictional litigation and international arbitration, securitization of claims, exequatur procedures, writ of execution-related procedures.

Employment and Immigration: With a proven competence in social-security matters, structuring of employee contracts in the context of large international groups, monitoring of compliance with employment, social security, anti-discrimination, personal data protection and employee dismissal legislation, the team helps clients conform their workplace practices and procedures to local law. The department is equally experienced in employment litigation on matters ranging from professional injuries to mass dismissals. Being among the first on the Bulgarian legal market to actually realize the interplay between the migration regime and various sectors, including foreign investments, taxation, social area, labour regulations etc., the firm established a separate department to specifically cover these matters. Clients are guided through a wide range of administrative procedures, such as issuing of visas for short term stay, prolonged residence permits and permanent residence permits for citizens of non-EU member states. Advice is also provided on long-term residence permits for foreigners who are citizens of EU countries.

EU and Competition: Well aware of the impact that competition rules have on all sectors of the economy, we consider both sets of unfair competition regulation (domestic and EU) when shaping complex advice on dominance, cartels, dawn raids, pricing, refusal to supply, etc. Our experience in cross-border M&As and foreign investments has significantly contributed to the development of a competition expertise in a multitude of industry sectors, including energy, agriculture, food and beverage, technology, financial services and healthcare. The team provides compliance support and merger control advice on domestic and trans-border mergers and acquisitions and other manifold transactions. Just as well, the department covers the interpretation and application of international private law in contentious trans-border issues. Clients are represented in competition-related litigation before national courts and the Bulgarian Commission for Protection of Competition.
IP, Leisure and Entertainment: The IP practice represents both local and multinational trademark and industrial design holders in numerous proceedings before the Bulgarian Patent Office, EUIPO and WIPO. In addition to registration services, the team concentrates on IP infringement and unfair competition litigation, cross-border licensing, anti-counterfeiting and customs measures. With firm positions in the media and show business, the IP team advises all participants in the leisure and entertainment industry – copyright owners, performing artists, TV and movie producers, broadcasters, collecting societies. Furthermore, the department audits intellectual property assets in the context of legal due diligence required for sale, acquisition and securitization purposes.
