Position

Zdenek Hustak is a Senior Lawyer at BBH. He has significant experience in capital markets oversight and focuses on financial capital markets, especially banking and insurance including the regulatory issues. From 2003 to 2006, Mr. Hustak was a Member of the Presidium of The Czech Securities Commission responsible for the supervision and regulation of investment services, regulated markets and clearing houses and the settlement system. He was subsequently named as adviser to the Deputy Finance Minister at The Ministry of Finance of the Czech Republic where he led the transposition of the market per the financial instruments directive (MiFID) toward a new domestic system of law. During The Czech Presidency of the EU, Zdenek led a working group of the EU Council implementing the regulation of Rating Agencies.

Zdenek Hustak graduated from Masaryk University in Brno (1998) and the Economics and Administration Faculty of Masaryk University in Brno (1997).

  • Judicial review of arbitration awards in the Czech Republic in light of recent legal developments

    The two basic means of dispute resolution in the Czech Republic are judicial proceedings and alternative dispute resolution. Arbitration proceedings, as a form of ADR, is thriving. According to statistics of the Arbitration Court attached to the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic, one of the three permanent arbitration courts in the Czech Republic and the only one with general jurisdiction, in the year 2000 the mentioned court settled 196 disputes, while in 2009 it settled 1402 disputes (not including disputes settled amicably).

    The Directive of the European Parliament and of the Council 2006/123/EC of 12 December 2006, on services in the internal market ("Directive" or "Directive on services") substantially develops the freedom of establishment and freedom of cross-border provision of services under Articles 43 and 49 of the EC treaty.
