Summary The Royal Court has just handed down a judgment in a case involving an appeal against a decision of the Minister (then Senator Cohen) to refuse planning permission which is significant in two respects.

The Jersey Financial Services Commission has adopted a new policy setting out a fast track, self-certification procedure for authorising a "Private Placement Fund", being a fund: • which is either established in Jersey or managed in Jersey • which is closed ended • whose units are offered to not more than fifty investors • which only admits "sophisticated investors" or professional investors" (see appendix)

From January 2012 a new streamlined regulatory authorisation process for the establishment of privately placed funds is available in Jersey.
