ARBITRADE successfully represented Ukrainian client in the course of SCC arbitration in a dispute related to high-profile case on purchase of the printing equipment. The case has been settled at the mature stage following intensive exchange of comments and hearing conducted in Stockholm in January 2014. The case has been complicated by jurisdictional objections, bifurcation, technical aspects of dispute related to the high-profile equipment, and numerous expert opinions on conformity of the equipment to the contract, on reduction of contractual prices etc. The settlement agreement reached is the most advantageous for the ARBITRADE's client under the circumstances. The case was handled by partner Yuliya Chernykh, C.Arb and Yarslava Sorokhtey, associate.

On 28 February 2014 Yuliya Chernykh, partner with ARBITRADE and member of the Panel of recommended practitioners at the  Vienna International Arbitration Center,  presented a speech on ex aequo et bono at the Vienna Arbitration Days.  

The Conference dedicated to applicable law in international arbitration gathered more than 200 arbitration practitioners from all over the world.

Vienna Arbitration Days is the annual leading arbitration conference in Austria organized by ICC Austria, Austrian Yearbook of International Arbitration, Vienna International Arbitration Center and UNCITRAL.  The organizing committee consisted of Christian Dorda, Manfred Heider, Christian Klausegger, Alexander Petsche and Stefan Riegler.

ARBITRADE successfully represented UK-based grain trader in pre-arbitral settlement

ARBITRADE acted as counsel for a UK-based seller in a dispute with the major Turkish purchaser of grain. The dispute arose out of the buyers' default under the Contract incorporating GAFTA 49 standard form.   • Ukraine enables itself to furnish procedural orders of foreign judicial and arbitral authorities

    The Cabinet of Ministers of Ukraine at its meeting on August 29 resolved [1] to amend its Resolution "On approval of the Order for the use of funds allocated in the state budget for payments related to implementation of judgments of foreign jurisdictional authorities rendered upon consideration of matters against Ukraine" (the "Government Resolution").[2] Appropriate amendments were prepared by the Ministry of Justice (responsible for protecting the state's interests in foreign courts and arbitral tribunals) in order to improve mechanisms to protect the rights and interests of Ukraine in foreign judicial and arbitral proceedings.

  • New Law on LLCs in Ukraine

    The Law of Ukraine On the Limited Liability Companies and Additional Liability Companies passed on 6 February 2018 shall come into force on 17 June 2018. The Law is a positive sign for doing business in Ukraine as it introduces significant changes and innovations in the legal regulation of the establishment and activities of limited liability companies, which are the most numerous and the most popular form of entrepreneurial activity in Ukraine (second only to individual entrepreneurs).
  • The Code of bankruptcy procedure in Ukraine: positives and negatives of the new document

    The Verkhovna Rada registered a draft law on the Code of Bankruptcy Procedure (No. 8060). Among other things, it is noted that such a document will increase the efficiency of bankruptcy procedures, the level of protection of the rights of creditors, improve the procedures for selling debtor property at the auction, increase the level of execution of contracts and court decisions.   • CHANGES TO PPA: TO MAKE FINANCIAERS HAPPY

    Over the last few months before January 2018, when the latest changes to the power purchase agreements (PPAs) between State Enterprise ‚ÄúEnergorynok‚ÄĚ and producers of energy from alternative sources were adopted, more than ten agreements were signed with upgraded conditions set earlier in 2017. Many of those disputes are still pending, thus, keeping finance arrangements among the top-litigated issues within CIS borders.

    Article V1(b) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, better known as the New York Convention, provides that recognition and enforcement of a foreign arbitral award may be refused, at the request of the party against which it is invoked, only if that party furnishes proof to the competent authority where the recognition and enforcement is sought that it was not given proper notice of the appointment of the arbitrator or of the arbitration proceedings. However simple at first glance, the question of what constitutes 'proper notice' turns out to be less than clear in practice.
