AVELLUM wins swaps case in GAFTA arbitration

April 2019

AVELLUM successfully represented an Estonian company in GAFTA arbitration in a dispute regarding debt recovery under swap contracts.

Swap contracts provide for exchange of a floating price for a fixed price for the goods on a specified date, which makes them an effective instrument of hedging the risks arising out of market price fluctuations. Contrary to ordinary sale contracts of agricultural products, swap contracts do not provide for the physical delivery of the goods.

Swap contracts are frequently used on financial markets. However, they are still on a beginning stage when it comes to international trade of agricultural products in the Black Sea region.

AVELLUM is amongst the pioneers of successful dispute resolution under swap contracts in GAFTA arbitration. In their decision, the GAFTA Tribunal supported the claimant’s position and awarded the debt under swap contracts in sum of around USD150,000, as well as interest for the delay in payment.

Besides, AVELLUM has also successfully continued the practice of dispute resolution under the simplified procedure in accordance with GAFTA Arbitration Rules 126, which enabled the claimant to obtain the arbitral award within the shortest time-period.

The AVELLUM team was led by partner Ivan Kasynyuk, with support from senior associate Iurii Gulevatyi and associates Leila Kazimi and Victoriia Tolochko.

  • Competitors as accomplices

In 2019, it is getting apparent that violations of antitrust law, in particular in the area of anticompetitive concerted actions (for example, price collusion of oil traders or food products wholesalers) not only become dangerous due to the sanctions of the Antimonopoly Committee of Ukraine (hereinafter referred to as the AMCU), but also add a competitive intrigue to the principle – who will be the first who declare to the AMCU.
  • Antitrust Law Aspects in Ukraine

Ukraine, like other European countries, developing a market economy on their territory, has incorporated antitrust regulations and legal mechanisms in its legislation to regulate and support competition, as well as rules to ensure fair competition. An integral part of the competition control is the control exercised by the Antimonopoly Committee of Ukraine over M&A transactions both in Ukraine and abroad, which may also affect Ukrainian domestic markets.

  • Medicines advertising and unfair competition in Ukraine

In Ukraine, advertising of medicines represents the largest share in terms of volume both on TV and Internet. Advertisers are increasingly struggling to attract the attention of older advertising consumers, strongly influenced by advertising as they trust the advertising messages they see, read or hear and do not seek advice from a doctor. At the same time, an important role is played by the advertiser’s strict adherence to the advertising law requirements for protection against unfair competition when creating and placing advertisements related to medicines and medical products, etc.

  • Inward Processing in Ukraine

For years the Ukrainian government has been making efforts to find effective solutions to increase the Ukrainian economy efficiency and to create conditions for its further growth. To find such solutions is not an easy task. It is also important to take a closer look at the experience of the countries that used to have similar economic starting positions as Ukraine has now.
