Foyen successfully represents client before the Supreme Court

16th of June 2020 Partner Jonas Nilsson and associate Johanna Lenell have successfully represented one of Foyen's clients before the Supreme Court of Sweden. The judgment was handed down today, Tuesday 16 June. A major construction and contracting company was seeking almost SEK 10 million in compensation for personal liability under the Companies Act when the case was filed in the courts. The question which the Supreme Court has now considered is when in time liability for litigation costs arises. The Supreme Court agreed with the position advocated by us that an obligation to pay litigation costs arises on a continual basis as the costs are incurred and not when the judgment is issued. Given the outcome in the Supreme Court, the earlier holding by the Court of Appeal for Western Sweden remains in force and our client is only ordered to pay SEK 50,000 to the opposing party in respect of a minor issue in the case, while our client has their litigation costs compensated by the other party. The renewable energy company OX2 has executed a sale and purchase agreement with Fontavis, a Swiss asset manager specialising in renewable energy and infrastructure investments.  The agreement is for 33 MW from the Orrberget wind power farm, with nine wind power turbines, which will be constructed in the Municipality of Ludvika.

Huge Fastigheter is selling nine public-use properties with public operations in Huddinge comprising a total lettable area of 8,750 m² and approximately SEK 16.8 million in rental income. The buyer is Samhällsbyggnadsbolaget (SBB), which shall take possession of the properties in the beginning of October 2017.

Johanna comes most recently from Alingsås Municipality where she worked as a procurement manager for two and a half years in charge of the municipality's procurement activities and with personnel responsibility for five employees. As procurement manager, Johanna has had a role as a coordinator and strategist that involved decision support for the municipal leadership with respect to various legal issues and responsibility for training in procurement, both internally within the municipality and externally directed towards the business community.

Foyen has represented Åby Travsällskap in a trade fair centre and hotel joint venture project

Åby Travsällskap has entered into a joint venture with Klövern for the construction of a trade fair centre and hotel adjacent to the Åby Racetrack in Mölndal. The project value is approximately SEK 500 million and approximately 30,000 sq. m. of lettable space is involved.


Foyen assists Slussgården in the sale of a city property

Slussgården sells the property Lammet 17 located at Korgmakargränd 2-6, Bryggargatan 4 and Gamla Brogatan 13, a short distance from Drottninggatan and Kungsgatan. Slussgården acquired the property during the summer of 2014 from Fabege.

Drone law in five minutes

The Swedish Supreme Administrative Court has recently ruled that drones equipped with cameras are subject to the Swedish Camera Surveillance Act. This means that photographing with drones in public areas requires a permit from the county administrative board. The Swedish Supreme Administrative Court’s decision has given rise to lively debate. Linnéa Djursén new CEO of Foyen

Linnéa Djursén took over as CEO of Foyen the 1st of January 2017. This makes Foyen the only major law firm in Sweden with a CEO who is not a member of the Swedish Bar Association. In addition, Linnéa Djursén is one of the few women executives in the industry. The goal is for Foyen to be the obvious choice for clients with technology-intensive businesses in need of legal expertise.


Foyen assists Schneider Electric in the sale of a property to Nyköping Municipality

Nyköping Municipality recently completed a strategic acquisition of a property of approximately 100,000 square meters in Arnö. The Technical Division in Nyköping Municipality will now be relocated to the property, which in turn will enable the construction of 200-300 centrally located Residences. The size of the property also allows for future relocation of other municipal activities and, consequently, among other things, the creation of additional new housing opportunities in central Nyköping. The property was conveyed by Schneider Electric for a purchase price of SEK 56 million.


Foyen assists with the sale of the Hemnet website for SEK 2 billion

General Atlantic and a consortium comprising investors Pierre Siri, Henrik Persson and investors involved in Merro, an investment company, are becoming the new owners of Hemnet. The amount of the sale is SEK 2 billion. The current owners, Mäklarsamfundet and Fastighetsmäklarförbundet, will retain minority interests in Hemnet. The previous owners, Fastighetsbyrån and Svensk Fastighetsförmedling, are selling all of their holdings in Hemnet.

Foyen assists OX2 regarding Högkölen wind farm

The renewable energy company OX2 has been awarded the construction contract for the Högkölen wind farm generating 65 MW (18 wind power turbines) in Ljusdal. The customer is Aquila Capital. Foyen Advokatfirma assisted OX2 in the negotiations regarding the turbine supply agreement and the service agreement. The partner in charge at Foyen was Jacob Hamilton.


Foyen advises Slussgården on acquisition of property from Skanska in Stockholm

The Foyen Law Firm represented Slussgården in its acquisition of Skanska’s Snäckan 8 office property in downtown Stockholm, where KPMG previously had its headquarters. Through the purchase, Slussgården increases its ownership by just over 23,500 square metres. The acquisition is conditional on a new zoning plan and building permits.
