Position

Mihkel Miidla, a senior associate, is head of the Information Technology & Data Protection Practice and Communications, Media & Technology (CMT) Sector Group in Estonia.

Career

In recent years Mihkel has been heavily involved in most of the more complex IT and telecoms related cases at SORAINEN. As a specialist in IT law, Mihkel provides excellent support in cases where IT and IP are closely related. Mihkel has significant experience in the field of service and trade contracts, having assisted many local and international businesses in trade deals as well as in setting up trade operations in Estonia and abroad. He has gained valuable experience in product and service related issues ranging from advertising and labelling requirements to complex industry specific competition (e.g. automotive industry, energy and utilities) and regulatory issues. Mihkel has extensive knowledge in the personal data protection field and has contributed to Privacy International's multijurisdictional study "European Privacy and Human Rights 2010" funded by the European Commission and several other EC studies ranging from SPAM and spyware to eHealth and electronic documentation delivery. Before joining SORAINEN, Mihkel worked as a legal trainee in the Civil Chamber of the Estonian Supreme Court.

Sorainen’s IP practice regularly handles commercial franchise systems, licensing agreements and litigation. Headed by Kaupo Lepasepp, it is representing Roche Eesti in a complex pharmaceuticals patent dispute, which has been referred to the European Court of Justice. The IT law team, led by senior associate Mihkel Miidla, advises on launching new technological services (Elisa Eesti is a recent client in this regard), compliance matters and data protection.

  • New requirement for all issuers operating on the Luxembourg Stock Exchange

    On 10 August 2017 the Luxembourg Stock Exchange announced that all domestic and foreign issuers operating on the regulated market (Bourse de Luxembourg) or on the multilateral trading facility (Euro MTF) of the Luxembourg Stock Exchange must provide their legal entity identifier (“LEI ”) codes to the Luxembourg Stock Exchange before 15 September 2017.

    The question of the scope of the cost-sharing VAT exemption, also referred to in the Council Directive 2006/112/EC of 28 November 2006 as amended ("EU VAT Directive") as “Independent Groups of Persons” or “IGPs”, is currently being debated at the Court of Justice of the EU (“CJEU”) in several cases. Last Thursday marked the first milestone regarding this specific VAT exemption since the CJEU released its judgment in the case Commission v Luxembourg (C-274/15).

    In the UAE, the risk management activities inherent in running a corporate or investment banking business remain of crucial importance, not least because of the strong local characteristic of “name lending”, by which is meant lending or providing other banking facilities to family or other private businesses, primarily on the strength of the “name” or “names” of the proprietors standing behind the business, rather than on the strength of the asset quality and underlying credit of the particular business. Of course, in practice, there is commercial overlap between the proprietors and the companies which they own, but the credit analyses can break down where poor banking practices and procedures result in poorly constructed legal documentation and gaps in guarantee and security support documents.
