Back to the TV Format war! Recently the TV network TELECINCO has requested, via injunction, that a commercial Court in Madrid orders the cancellation of the programme “EL NUMERO UNO”, that ANTENA 3 DE TELEVISION –another TV network was broadcasting on a weekly basis.

TELECINCO’s grounds were that, as a network it had emitted the latest editions of the program “OPERACIÓN TRIUNFO”, and it still had an option to release another edition, the broadcast of ANTENA 3’s programme was causing it serious damages. The injunction request was also filed against the producer of the show, GESTMUSIC ENDEMOL, also the producer of “OPERACIÓN TRIUNFO”. Did TELECINCO believe that GESTMUSIC was plagiarizing itself?...In any event, the Commercial Court nº 11 of Madrid dismissed TELECINCO’S injunction petition in full, ordering them to pay costs. Unfortunately the dismissal was on the grounds of procedural and formal aspects, without going into the main issues, which would have been much more interesting. The decision is now firm, as TELECINCO has not filed a claim on the merits of the case. SOL MUNTAÑOLA ABOGADOS represented the interests of GESTMUSIC ENDEMOL, the show producers.
