Who’s Who Legal: Competition 2018 recognizes four Sayenko Kharenko’s experts among the world’s leaders

Sayenko Kharenko’s competition team has recently received excellent rankings in Who's Who Legal's 2018 guides to the world's top competition law experts. Four Sayenko Kharenko’s lawyers are recognized in this year’s list: Vladimir Sayenko, Valentyna Hvozd, Maksym Nazarenko and Dmitry Taranyk. Vladimir Sayenko is named among the world’s leading individuals by Who’s Who Legal: Competition 2018. The 19th edition is the most comprehensive ever, now covering 1069 competition experts. The lawyers selected advise and defend clients in internal, regulatory and criminal investigations as well as assisting with merger filings, civil and criminal litigation and cartel matters.

Sources described Vladimir Sayenko as a “great lawyer in the area” and “one of the main names” who is praised for his strong connections in the competition field and is “experienced in merger control” and “a real authority when it comes to competition law in Ukraine”.

In 2018, Who’s Who Legal represents its second edition of the Competition - Future Leaders list. This chapter recognizes 241 partners and 230 non-partners aged 45 and under at the end of 2018, whom the market has identified as specialists standing out for their competition law expertise. Maksym Nazarenko is the only lawyer representing Ukraine in this year’s list. The sources praise him as “absolutely fantastic”, highlighting that it is “really excellent to see him in action”. He is further acknowledged as a “merger control specialist who is applauded for his pragmatism and efficiency”.

    The Law of Ukraine On the Limited Liability Companies and Additional Liability Companies passed on 6 February 2018 shall come into force on 17 June 2018. The Law is a positive sign for doing business in Ukraine as it introduces significant changes and innovations in the legal regulation of the establishment and activities of limited liability companies, which are the most numerous and the most popular form of entrepreneurial activity in Ukraine (second only to individual entrepreneurs).

    The Verkhovna Rada registered a draft law on the Code of Bankruptcy Procedure (No. 8060). Among other things, it is noted that such a document will increase the efficiency of bankruptcy procedures, the level of protection of the rights of creditors, improve the procedures for selling debtor property at the auction, increase the level of execution of contracts and court decisions. However, does the text of the document correspond to the stated purpose?

    Over the last few months before January 2018, when the latest changes to the power purchase agreements (PPAs) between State Enterprise “Energorynok” and producers of energy from alternative sources were adopted, more than ten agreements were signed with upgraded conditions set earlier in 2017. In the mentioned agreements, the changes to the PPAs were applied and helped bring Ukraine’s PPAs closer to international standards. Nevertheless, the revised PPAs still have a lot of issues that need to be clarified and further elaborated to make them perfectly bankable, and to make them properly executable.
